Abstract

Technological developments turned out to have a major influence on changes in community economic transactions. The system that was once used by the community is a manual system but technological developments bring it to change into an online system that all transactions can be done without having to face to face, without being influenced by time and place. So, that the community is spoiled by the system. Not only in the scope of economic transactions around trade, but this online system has also been used in zakat payment transactions that use electronic money. The purpose of this research is to see how the legal use of electronic money when used to pay zakat. To achieve the objectives of this study the authors use the method of library research, namely by examining documents both published officially or contained in all printed materials, or in electronic form relating to the topics discussed. From the results of the analysis conducted by the author on these data it can be concluded that electronic money Go-Pay may not be used because it is not in accordance with the provisions of DSN-MUI. When electronic money or Go-Pay should not be used, Go-Pay also should not be used to pay zakat.

Abstract

Historical approach is a method used in analyzing a problem. In this paper the historical approach is used to look at the factors that influence the opinion of Imam Hanafi on the position of ownership of waqf property. According to the opinion of Imam Hanafi when a waqf endows his property, it does not make the transfer of ownership of the waqf property. Until the endowment property still belongs to a wakif even though the property has been endowed. After a study, it was concluded that Imam Hanafi's opinion was influenced by his past history as a trader. In addition, the State of Iraq, where he lived, was far from the source of hadith in the time of the Prophet, so Imam Hanafi was more dominant in using Ra'yu in viewing and establishing the law on an event that occurred.

Abstract

Perbandingan pesatnya perkembangan perbankan syariah di Indonesia dengan daerah Timur-Timur serta Pakistan memberikan gambaran yang sangat berbeda. Mengapa tidak, harus diakui negara-negara di bagian Timur Tengah merupakan negara pelopor pertumbuhan perbankan syariah. Sehingga sangat tidak diherankan jika perkembangannya juga begitu pesat di Timur Tengah dibandingkan di Indonesia. Begitu juga dengan dorongan-dorongan dari berbagai pihak baik pemerintah maupun warga negaranya. Di Pakistan dukungan dari pemerintah begitu kuat dengan dilakukan pelarangan penggunaan sistem perbankan konvensional. Seiring dengan perkembangan perbankan syariah tersebut, tingkat penerimaan dari masyarakat juga begitu meningkat. Meskipun dibersamai oleh pandangan sebagian masyarakat yang menganggap bahwa perbankan syariah hanya merupakan labelisasi semata. Kata Kunci: Perbankan Syariah; Sejarah; Perkembangan; Timur Tengah dan Pakistan

Abstract

Expectations of increased development of Islamic banking is one of the targets by the government in the year 2023. To achieve this target in recent years, the government conducted a roadmap by requiring all Islamic business units that are in conventional commercial banks to separate themselves. So that every sharia business unit will turn into a sharia commercial bank. It becomes a challenge for every UUS in facing spin-offs, especially in preparing a large amount of capital. Therefore, many UUS are not ready financially for spinoffs. So the solution offered by the author can be in the form of a review of Law Number 21 Year 2008 concerning Sharia Banking which is the legal basis for the spin-off policy. In addition, BUK needs to prepare the maturity of UUS to face separation. Without exception the preparation of the UUS itself in improving services and the addition of banking products offered. Besides that, education is also very important to educate the public.
