Abstract

Penelitian ini bertujuan untuk mengkaji lebih dalam mengenai polemik pertanahan di D.I Yogyakarta. Selain itu, kewenangan kebijakan pertanahan yang diterapkan di D.I Yogyakarta apakah sesuai dengan Undang-Undang Nomor 32 Tahun 2004 yaitu otonomi daerah bertujuan untuk memberikan kesejahteraan bagi masyarakat. Uraian poin penting dalam penulisan ini yaitu sejarah pertanahan Daerah Istimewa Yogyakarta, pelaksanaan sistem pertanahan di Daerah Istimewa Yogyakarta, serta pengelolaan dan pemanfaatan tanah Kasultanan dan Kadipaten. Ketiga hal tersebut diolah menggunakan metode hukum normatif dengan pendekatan perundang-undangan sebagai bahan hukum primer. Analisis dilakukan secara kualitatif dengan sistem penulisan bersifat deskriptif analisis. Hasil penelitian dapat disimpulkan bahwa adanya dualisme hukum pertanahan D.I Yogyakarta yaitu hukum nasional (UUPA) dan hukum adat (Rijkshblaad). Penengah atas polemik tersebut, maka muncul Undang-Undang No. 13 Tahun 2012 tentang otonomi khusus bagi D.I Yogyakarta berfungsi untuk mengatur urusan rumah tangganya sendiri, termasuk sistem pertanahan. Sistem pertanahan yang ada di D.I Yogyakarta berbeda dengan daerah lain guna menjaga asal usul sejarah pertanahan D.I Yogyakarta. Otonomi daerah mempunyai tujuan untuk mensejahterakan masyarakat. Pengelolaan dan pemanfaatan tanah Kasultanan dan Kadipaten untuk kepentingan kebudayaan, kepentingan sosial serta kepentingan publik dengan didapatkannya perizinan baik dari Kasultanan maupun Kadipaten.

Abstract

The concept of consumer protection is to guarantee legal certainty to consumers, namely efforts to empower consumers to obtain or determine their choice of goods and/or services and to defend or defend their rights if business actors harm them. Legal norms to protect the interests of consumers are not sufficient. Therefore, to achieve a balance in protecting the interests of consumers and business actors, a clear legal order is needed so that a healthy economy can be realized. Consumer protection norms in the Consumer Protection Law System, as a fundamental norm, become the criteria for determining alleged violations of consumer rights. The aim of this study is to provide an alternative for resolving cases, a form of embodiment of the implementation of consumer rights protection policies. The approach method used in this research is juridical sociological. However, there are still legal loopholes that often occur. May harm the interests of consumers. The existence of regulations that still have to be synchronized and harmonized between the Consumer Protection Act and the rules governing Arbitration and Alternative Dispute Resolution issues because the Consumer Protection Law formulates rules for resolving consumer disputes by separate arbitration, which is relatively different from the basic concept of the arbitration mechanism which generally accepted so that the settlement of consumer disputes becomes legal uncertainty.

Abstract

This study examines the application of Regional Regulation No. 11/2012 on road and river boundary lines and evaluates the effectiveness of its sanctions in Cirebon Regency, Indonesia. The issue of illegal buildings violating road and river borders remains prevalent, mainly along Jalan Pilang. This research analyzes how effectively the regulation and its sanctions are implemented to curb these violations. The study employs an empirical juridical approach, using primary and secondary data from field research, document reviews, and interviews. The findings reveal that enforcing sanctions under Regional Regulation No. 11/2012 could be more effective, with numerous illegal structures still encroaching on regulated boundaries. Although supported by legal provisions, the local Government's enforcement efforts face challenges due to community non-compliance and insufficient enforcement mechanisms. The results highlight the need for more vigorous regulatory enforcement and public awareness to uphold spatial planning laws. This study contributes to understanding the complexities of spatial regulations and provides recommendations for enhancing legal compliance in local governance.
