Abstract

This paper conducted a comparative study between the qualitative requirements for members of the Syuro Council in Islamic Constitutional Law (Siyasah) and the voter qualifications in the presidential election system in Indonesia. This comparative study is normative research with a literature review. As a result, voter qualifications in general elections in Indonesia have only reached qualifications that are externally administrative in nature and tend to be formal. When compared with the formulation of qualitative-substantive requirements set by Imam Al-Mawardi, voter qualifications in Indonesia still do not reach the qualification aspects of integrity, intellectual capacity, or rhetorical capacity.

Abstract

This study discusses the Juridical Analysis of the President's Authority in Appointing the Head of the State Capital Authority. The direct appointment of the Head of the State Capital Authority by the President has opened up the opportunity for regional heads to be appointed by the President again as in the New Order era, where the heads of level I regions were appointed by the President from among the candidates proposed by the Regional People's Legislative Assembly concerned. The formulation of the problem to be examined in this study is what is the position of the head of the IKN authority in the state administration system in Indonesia? And is the president's authority in appointing the head of the IKN authority in accordance with the provisions of the 1945 Constitution? This research is a normative juridical research, the approach is carried out using a statutory approach. The results of this analysis are that the position of the head of the IKN authority in the constitutional system in Indonesia when referring to constitutional provisions can at least refer to the term governor if the IKN is categorized at the provincial level. In addition, the president's authority in appointing the head of the IKN authority based on the provisions of the 1945 Constitution is in accordance with the provisions of the 1945 Constitution, even though the appointment of the Head of the IKN authority is not democratically elected through direct election by the people or people's representatives.

Abstract

This paper discusses President Joko Widodo's campaign practices in the 2024 election by highlighting ethical issues from the perspective of Pancasila and Islamic Ethics. As head of state, President Jokowi has a strategic position that demands moral exemplarity, political neutrality, and commitment to social justice. In practice, Jokowi on the one hand shows a positive attitude by rejecting the politicization of identity, religion, and intolerance that have the potential to damage the unity of the nation. However, on the other hand, his statement that the president is allowed to campaign and take sides, support for his son's candidacy as a vice presidential candidate, and the massive distribution of social assistance during the election period have raised ethical criticism. From the perspective of Pancasila Ethics, these steps cause conflicts with popular values, social justice, and the principle of unity. Meanwhile, Islamic Ethics which emphasizes justice ('adl), trust, honesty (ṣidq), and leadership that is beneficial to the ummah considers that these practices have the potential to contain conflicts of interest and obscure the mandate of office. Thus, President Jokowi's campaign reflects the dialectic between efforts to maintain political stability and national unity with ethical problems related to neutrality, justice, and leadership morality. This study emphasizes the importance of Pancasila and Islamic ethics as normative guidelines in maintaining the integrity of Indonesian democracy.
