Abstract

Abstract This paper departs from the criminal acts of any problems related to money laundering as suplementary crimes and is there a legal basis for implementing the transfer of the burden of proof is absolute (shifting burden of proof) in the process of money laundering. The results of the study concluded that in addition to corruption, crimes related to money laundering as well suplementary narcotics crimes, banking fraud, forgery letter as a predicate crime. The legal basis for implementing the transfer of the burden of proof is absolute (shifting burden of proof) in the process of money laundering is applied Article 69 of Law No. 8 In 2010, the point of origin or the predicate offense is not mandatory crime proved first. Keywords : money laundering, predicate crime.   Abstrak Tulisan ini berangkat dari permasalahan tindak pidana apa saja yang terkait dengan pencucian uang sebagai suplementary crimes dan adakah landasan hukum untuk menerapkan pengalihan beban pembuktian secara mutlak (shifting burden of proof) dalam proses tindak pidana pencucian uang. Hasil kajian menyimpulkan, bahwa selain korupsi, tindak pidana yang terkait dengan pencucian uang sebagai suplementary crimes juga narkotika, perbankan, penipuan, pemalsuan surat yang menjadi predicate crime. Landasan hukum untuk menerapkan pengalihan beban pembuktian secara mutlak (shifting burden of proof) dalam proses tindak pidana pencucian uang diterapkan Pasal 69 UU No. 8 Tahun 2010, yang intinya tindak pidana asal atau predicate crime tidak wajib dibuktikan terlebih dahulu. Kata Kunci : pencucian uang, predicate crime.

Abstract

Corruption eradication requires not mere technological hardware and good legal enforcement institutions, but this again, requires software instrument in the form of legal culture, which encompasses the ideology of law and the ideology which legal apparatus adopt. More importantly, in this globalization era, corruption prevention interconnects with politics, economics, culture, law, and international world. Two elements, namely social-political control, as well as penalization which is derived from the ideal concept of justice, are key elements in this regard.

Abstract

Based on political corruption study and its correlation to the law and governance in modern countries, this research was aimed at identifying how political corruption correlates to socio-political, socio-economic, socio-cultural, socio-juridical and human right dimensions. To have social relevance to juridical analysis, this research also analyzed the strategy/policy to overcome the political corruption phenomena. Literary analysis and interviews with several experts having relevant scientific competence were the main basis for the research to compose this dissertation. The correlation between variables of the data obtained from the analysis of the content and the norm was described. The phenomena of legally prohibited corruptions were also compared. The political corruption analyzes in several modern countries, it is clear that political corruption has more extensive impact than corruption by the people without political position. The entity of political corruption is closely related with the power. Political corruption always attempts to maintain and extend the power abuse and the need for socio-political order requires equivalent control role in the implementation of the power. Political corruption correlates to human rights violation by governmental heads because political corruption is closely related to the desire to maintain and extend power.Key word: corelation, politic coruption, modern state

Abstract

In issuing the court in Indonesia, the independence of the court is often interfered by power interest with many various background. Today, after the act No. 4, 2004 on the Judicial Affairs and the act No.5, 2004 on The Supreme Court issued, the effort of interference are probably not repeated. It is caused that judicature institution both in organization, administration and financial are not directedbyDepartment of Administration, but it applies the one roofpolicy underthe Supreme Court. Abstract

Dalam reformasi hukum pidana politik hendaknya diingat bahwa kejahatan politik tidak hanya dilakukan oleh individu atau organsiasi melawan pemerintah, terutama yang mencoba merubah sistem politik yang dilakukan pemerintah melawan rakyat dan melanggar kemanusiaan. Secara yuridis ketentuan hukum pidana yang mengatur tentang tindak pidana bidang politik di Indonesia secara historis dapat mempergunakan UU Subversi dan beberapa pasal-pasal KUHP, khususnya tentang makar. Perumusan Undang-Undang Subversi ternyata terlalu luas sehingga perlu direformasi dengan term-term hukum, bukan term-term politik sehingga tidak merugikan tersangka, karena pasti dapat terjerat dan dihukum. Berikut ini penulis mencoba mengemukakan ide dan gagasannya seputar reformasi hukum pidana politik. Lalu, apa sebenarnya yang ditawarkan penulis tentang reformasi hukum pidana politik itu sendiri.

Abstract

The law is never process and Its existence free from vacuum space but it becomes and Involves with other factors, for instances social, political, economical and cultural factors. Especially in the context of law enforcement regarding the corruption. Besides, the law enforcement also concerning to jurimetrics or the scientific investigation of legal problem. In term of this, the process of law enforcement needs skill and knowledge. According to the author that the corruption in Indonesia constitutes a systemic destructed in political system mechanism, so it is an extra ordinary crimes, it needs to be deconstructed law system and law enforcement system in Indonesia, and the law enforcement in the cases of political corruption in Indonesia needs an integrated institution of law and law enforcement.
