Abstract

The verdict of the Constitutional  Court, as the nature of a court decision, implies the rights that the justice seekers enjoy. It is unfortunate however, the appeal procedure for those who are not satisfied with such verdict is not issued yet, and this may produce the disadvantages  for the purpose of affording justice. For such reason,  the amendment on the Constitutional  Court procedures, particularly in appeal procedures, is highly demanded.

Abstract

The Constitutional Court adjudication, as the nature of a court decision, implies the rights that the justice seekers will appreciate. It is unfortunate, however, that the appeal procedures for those who dissatisfied with such adjudication has yet to be issued, and this may produce the disadvantages for the purpose of affording justice. Abstract

Our research attempts to understand the absolute competence of arbitration and its development in practice as well as the effect of the parties' choice of jurisdiction in a contract containing arbitration clause. This research is expected to be able to explain the competence dispute between arbitration and court to justiciables. We find that choice in jurisdiction would negate the rights of the parties to submit their dispute to district court. In practice, deviation where courts may ignore the arbitration clause, the parties' good faith and consistency of the court play a significant role to further develop the arbitration process. Penelitian yuridis-normatif ini dilakukan untuk mengetahui kompetensi absolut arbitrase dan perkembangannya dalam praktik, serta akibat hukum pilihan forum dalam kontrak berklausula arbitrase bagi para pihak yang berpekara. Penelitian ini diharapkan dapat menerangkan para pencari keadilan perihal sengketa kewenangan mengadili antara arbitrase dan pengadilan. Hasil penelitian menunjukkan bahwa pilihan forum akan meniadakan hak para pihak dan sikap pengadilan yang konsisten memiliki peranan besar untuk mengembangkan arbitrase.

Abstract

The issues of human rights constitute the global issues recently that will not ignore with some reasons including in Indonesia. The concept of human rights and its realization in each state may not similar although actually the substance of human rights is equal. In this respect there are three concepts and implementations of human right in the world that be regarded as the representatives of western states, Socialism-communism and Islamic doctrine. The consequence of human rights emerges human obligations, that both human rights and human obligations are parallel and a system. The ignoring one of them will raise heavy infraction of human rights itself. The Implementation of human rights in Indonesia particularly even though many cases emerge generally either development or the maintenance ofhuman rights seems the progress. In this sense, the regulating law of human rights by legislating the rules and by establishing the Human Rights Court in overcoming many cases of heavy evading of raised human rights.

Abstract

The Supreme Court of Indonesia enacted Supreme Court Regulation (Perma) Number 1 of 2016 concerning Mediation Procedures in Court, which integrates mediation as a vital mechanism to reduce case congestion in the judiciary. As a first-level court, the Yogyakarta District Court is expected to prioritize mediation in civil case resolution. This study examines two key issues: (1) the role of judge-mediators in resolving debt default (wanprestasi) disputes at the Yogyakarta District Court, and (2) the obstacles faced by judge-mediators during the mediation process and efforts to overcome them. Employing a juridical-empirical approach, the study uses literature review and interviews as its primary methods of data collection. The findings reveal that the implementation of mediation by judge-mediators, as mandated by Perma No. 1 of 2016, remains suboptimal. Of the 15 cases mediated, only 5 reached a peaceful settlement. Several challenges contribute to this outcome, including the dual responsibilities of judges, the limited number of certified judge-mediators, and the lack of registered non-judge mediators. In addition, juridical barriers such as time constraints, inconsistencies in mediation agreements with legal norms, and the limited authority of mediators also hinder the effectiveness of mediation. Strengthening the mediation framework, increasing the number of competent mediators, and promoting the use of non-judge mediators are necessary steps to enhance the success of mediation in civil disputes.
