Abstract

ABSTRACTAl - Walāadalah peristilahan yang dipergunakan untuk menyebutkan seseorang yang memerdekakan hamba sahaya (budak), merupakan satu sebab orang mendapatkan warisan. Persoalan pemerdekaan hamba sahaya sebagai suatu sebab mendapat warisan hampir tidak diperhitungkan lagi dalam realitas kehidupan saat ini, hanya terbatas dalam perbincangan akademik saja tidak menembus kepada nilai-nilai sosial. Karena persoalannya tertumpu pada kenyataan, bahwa perbudakan sudah selesai. Namun bila memandang walā’ kepada susbtansi yang ingin disampaikan, sesungguhnya dalam sistem kewarisan Islam salah satu visinya adalah penghapusan perbudakan dengan jalan persaudaraan ( muakhah ). Mengapa demikian? Karena dalam pemerdekaan hamba sahaya ( al - Walā’ ) antara dua orang menjadi saudara. Apabila seorang budak dimerdekakan dan tidak mempunyai keturunan bisa mewariskan hartanya. Inilah nilainilai sosial yang ingin diangkat, agar hartawan dengan kekuatannya bisa menyelesaikan persoalan perbudakan. Bila memandang terhadap nilai “hak waris”, rasanya mustahil saat ini walā’ mendapatkan haknya. Tetapi bila memandang nilai “sosial”, maka makin banyak jiwa-jiwa dimerdekakan dari sistem perbudakan. Kata Kunci : al-Walā, Hamba Sahaya, Waris Islam, Hukum Waris, Perbudakan Modern.

Abstract

Penelitian ini untuk mengetahui kedudukan anak durhaka dalam haknya mendapatkan harta waris, ditelaah dalam KHI Pasal 171 poin (c), Pasal 173 dan 174. Penelitian adalah penelitian normatif dengan melakukan penelitian kepustakaan atau data sekunder dengan analisis deskriptif dan kualitatif. Yakni menggunakan bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier untuk kemudian menggambarkan korelasi anak durhaka terhadap Kompilasi Hukum Islam Pasal 171 poin c, Pasal 173 dan Pasal 174. Hasil penelitian ini menunjukkan bahwa; pertama, bahwa kedudukan anak durhaka terhadap KHI Pasal 171 poin c dan Pasal 174 tetap sebagai ahli waris dan mendapatkan hak waris. Kedua, kedudukan anak durhaka terhadap KHI Pasal 173 poin (a), bahwa ahli waris durhaka hilang hak mendapatkan warisan jika melakukan durhaka (khusus), karena sebab membunuh. Ketiga, kedudukan anak durhaka terhadap KHI Pasal 173 poin (b), maka perlu dipertegas dalam pasal dimaksud. Sebab durhaka bukan sebab terhalangnya ahli waris mendapat hak warisnya, hanya durhaka “membunuh” atau sebab “mempercepat proses pewarisan” sebagai penghalang mendapat waris. Sehingga bunyi KHI Pasal 173 poin (b) perlu diperkuat dengan tindak pidana atau perdata yang dengan sengaja untuk  mempercepat proses pembagian harta waris. Hal ini dimaksudkan untuk membatasi definisi “durhaka” pada persoalan Hukum Kewarisan Islam.

Abstract

This study aims to analyze the errors in the determination of heirs in the Religious Court of Malang Decision Number 0417/Pdt. P/2022/PA.Mlg and examine its legal consequences based on the Compilation of Islamic Law (KHI) in Indonesia. This study employs a normative juridical approach by reviewing the provisions of Article 185 of the KHI, various schools of Islamic jurisprudence (madzhab), and Gustav Radbruch’s theory of justice as analytical tools. The findings reveal that the judge’s determination, which classified Applicants II, III, and IV as dzawil arham, constitutes a misjudgment because, normatively, they are entitled to inheritance as substitute heirs. This error leads to legal consequences in the form of the loss of inheritance rights that should have been granted to the descendants of the testator’s sister, potentially creating legal uncertainty and further disputes. From the perspective of fiqh, although the Syafi’ i school rejects the concept of substitute heirs, the Hanafi and Maliki schools recognize the transmission of inheritance rights through both vertical and collateral lines of descent. The KHI accommodates the latter view to realize substantive justice within Islamic inheritance law in Indonesia. This study underscores the necessity of progressive legal reasoning (rechtsvinding) that aligns with maqāṣid al-sharī‘ah, so that judicial decisions are not merely textually grounded but also reflect the values of justice and social welfare.

Abstract

This study analyzes the disharmony between the principle of marital integrity as a legal norm and the sociological reality reflected in Divorce Petition Number 3701/Pdt.G/2024/PA.JS, particularly regarding the emergence of polyandry in the parties’ marital conflict. In Islamic family law and Indonesian positive law, the principle of marital integrity places divorce as a last resort to preserve family stability; however, judicial practice demonstrates that when the substantive objectives of marriage are no longer achieved, maintaining a formal marital relationship may instead create injustice. This research employs a normative legal method using statutory, conceptual, and case approaches, supported by qualitative analysis through legal and socio-legal interpretation of the judge’s considerations. The findings show that the judge interpreted the principle of marital integrity not textually but functionally, as an evaluative instrument to assess the sustainability of the marriage’s objectives. In this case, polyandry was viewed not only as a violation of legal norms but also as evidence of the breakdown of marital relations caused by prolonged conflict. The judge’s reasoning reflects a shift in ratio decidendi from a legalistic approach toward a socio-juridical perspective that considers psychological, social, and welfare aspects of the parties. Accordingly, the divorce decision was understood as a means of protecting individual dignity and well-being in line with the principle of legal benefit and the paradigm of maqāṣ id al-sharī‘ah. The novelty of this study lies in reconstructing the principle of marital integrity as a relational and conditional principle rather than an absolute one, thereby demonstrating that the tension between legal formality and sociological reality provides interpretative space for judges to balance legal certainty, substantive justice, and social benefit within the development of Islamic family law in Indonesia.

Abstract

The growing involvement of youth in violent extremism and radical movements has emerged as a pressing global concern, raising urgent questions about the underlying social and criminogenic factors that drive this phenomenon. This study aims to explore the pathways of youth radicalization through a criminological lens, identifying the key risk factors and proposing context sensitive prevention strategies. Using a normative juridical and descriptive analytical approach, the research examines relevant legal frameworks, criminological theories, and secondary data sources to develop a comprehensive model of youth radicalization. The findings reveal that radicalization is not a linear or homogenous process, but rather the result of intersecting influences such as social marginalization, institutional neglect, identity crises, and exposure to extremist narrative soften reinforced by digital environments. The analysis supports and expands upon strain theory and social disorganization theory, emphasizing the role of structural exclusion and weakened community ties. This study also identifies limitations in dominant counter radicalization strategies that rely heavily on surveillance and psychological profiling, arguing instead for holistic, rights based, and community driven interventions. The research contributes to the theoretical discourse on radicalization while offering actionable recommendations for policymakers, educators, and civil society actors. Its implications underscore the need for preventive frameworks that are ethically grounded, socially inclusive, and empirically informed. By shifting the paradigm from securitization to social resilience, this study advocates for a more just and sustainable approach to addressing youth radicalization.
