Abstract

This study aims to analyze legal supervision in preventing criminal practices and capital market violations. The type of research used in this study is the juridical-normative method, namely research on a legal principle contained in positive law that has been applied in Indonesia. The positive law in question is the regulation that regulates Capital Market Number 8 of 1995, the Law on the Financial Services Authority, and other Implementing Regulations. The types of legal sources used in this study are secondary legal sources and tertiary legal sources collected using the library research method. The research analysis used qualitative methods which were analyzed using a sociological approach. Qualification of forms of criminal acts Law no. 8/1995 concerning the Capital Market is regulated in Article 103 paragraph (1), Article 104, Article 106 and Article 107. As for criminal acts in the form of violations, it is regulated in Article 103 paragraph (2), Article 105 and Article 109. The forms of sanctions for violations are divided into: administrative sanctions, civil sanctions, and criminal sanctions.

Abstract

The purpose of this study is to analyze the role and implementation of the law in providing social security certainty for informal sector workers. This study uses a juridical-normative method. The types of legal sources used in this study are secondary sources of law which are discussed using a sociological perspective. The analysis and writing was done by qualitative method. Data was collected through interview techniques, giving questionnaires, and literature studies. The number of respondents in this study were 50 people who worked in the informal sector in the city of Palembang. The selection of respondents was done by purposive sampling technique. Based on the analysis of legal materials and sociological analysis, it can be concluded that the law protects social welfare through Law no. 40 of 2004 states that the National Social Security System adheres to the principle of compulsory participation for all residents in Indonesia. In the implementation of this policy, the informal sector is still experiencing several obstacles, including educational factors, economic factors and institutional factors so that the level of worker participation tends to be minimal and there is no equal distribution.

Abstract

The purpose of this study was to analyze the effectiveness of the socialization program carried out by the General Elections Commission as a medium of political education for the community. This study uses a type of juridical-normative research. The sources of law used in this study are secondary and tertiary sources of law. Sources of data were collected using questionnaires, interviews and literature studies. The location of this research was carried out at the General Election Commission office in Palembang. The data analysis method used in this study is a qualitative method which was collected during the research. The research respondents were 50 people who were selected using purposive sampling method. To maintain the validity of the data, field observation techniques and data triangulation techniques were used. Based on the results of the research data, it can be concluded that the socialization carried out by the General Election Commission of the city of Palembang was quite effective. This is supported by the strategy used, namely holding a political discussion forum, building an Election Smart House and carrying out direct outreach to novice voters who are in high school or equivalent, as well as two-way communication conducted by the General Election Commission of the city of Palembang.
