Abstract

ABSTRAKHukum sebagai alat control prilaku sosial masyarakat diciptakan guna memenuhi rasa keamanan,kenyaman,kesejahteraan dan keadilan dalam interaksi sosial sehari-hari dimasyarakat. Oleh karenanya sebuah strategi hukum diperlukan guna terciptanya perlindungan hukum secara universal. Perlindungan universal tersebut tertuang dalam berbagai aturan perundang-undangan di Indonesia. Akan tetapi dalam implemetasinya peraturan yang tertuang didalam berbagai bentuk perundang-undangan yang seyogyanya memberikan perlindungan hukum secara universal tersebut belum terlaksana seperti yang diharapkan,salah satunya tampak pada masih kurangnya perhatian terkait perlindungan terhadap pekerja wanita yang bekerja disektor UMKM khususnya di Kota Medan. Penelitian ini bertujuan untuk menelaah berbagai bentuk instrument hukum baik internasional maupun domestik yang mengatur tentang perlindungan hukum terhadap tenaga kerja wanita, dan melihat sejauh mana daya yang diperbuat oleh faksi terkait supaya efektifitas instrument-instrumen hukum tersebut benar-benar memberikan perlindungan secara universal khususnya bagi para tenaga kerja wanita yang sumber penghasilan nafkahnya berasal dari sektor UMKM di kota Medan. Metode kualitatif dalam penelitian ini digunakan dengan memakai konsep dasar hukum,esensial berbagai aturan perundang-undangan, dan dogma-dogma yang dapat menghasilkan solusi dalam penelitian ini.Hasil dari riset ini menunjukkan bahwa dalam implementasinya perlindungan hukum terhadap tenaga kerja wanita khususnya disektor UMKM di kota Medan masih jauh dari harapan, terlihat dari munculnya berbagai kasus ditengah-tengah masyarakat terkait dengan tenaga kerja wanita. Kendati demikian guna mengatasi hal tersebut sebenarnya Indonesia telah memiliki berbagai instrument hukum baik nasional maupun internasional yang tertuang didalam berbagai aturan perundang-undangan yang bahkan telah ada sejak kurun kerajaan hingga dengan sekarang. Guna terpenuhinya perlindungan hukum atas pekerja wanita sektor UMKM khususnya dikota Medan ini melibatkan banyak pihak terkait, seperti Pemerintah, Pengusaha/Asosiasi, NGO (NonGovernment Organisation) dan masyarakat. Adapun upaya yang dilakukan pihak-pihak tersebut pada intinya adalah dengan dilaksanakannya berbagai bentuk kebijakan dan program yang berkaitan dalam pengawasan dan pelaksanaan perlindungan tenaga kerja wanita khususnya di sektor UMKM.Kata Kunci : Perlindungan Hukum, Tenaga Kerja Wanita, UMKM

Abstract

AbstrakHukum dalam proses social engineeringberperan membentuk regulasi  yang mengontrol perubahan sosial dimasyarakat, antara lain dengan terealisasinya perlindungan hukum secara universal bagi masyarakat. Antara para pengemudi (driver) jasa transportasi online dengan pihak provider transportasi online memiliki hubungan  kemitraan sebagaimana yang diatur dalam hukum perdata, akan tetapi dilihat dari aspek hukum ketenagakerjaan hubungan kemitraan tersebut telah memenuhi unsur secara formal, yakni adanya kepercayaan, perintah dan upah. Tujuan dari penelitian ini adalah untuk melihat sejauh mana implementasi peraturan hukum yang ada dipatuhi dan memberikan perlindungan kepada masyarakat.Metode penelitian ini adalah kualitatif, yakni berdasarkan prinsip/azas hukum, doktrin dan peraturan perundangan yang dapat menjawab permasalahan dalam penelitian ini.AbstrackLaw as social engineering has played a role in forming regulations that control social change in society, among the realization of universal legal protection for society. Between the drivers of online transportation services with the online transportation, the provider has a relationship as regulated in civil law but viewed from the aspect of labor law the relationship has fulfilled the elements formally, namely the existence of the trust, orders, and wages. The purpose of this study is to see to what extent the implementation of existing legal regulations is obeyed and provide protection to the public. The method of this research is qualitative, which is based on the principles of law, doctrine, and legislation that can answer the problems in this study.

Abstract

The legal position between the drivers of online transportation services and the online transportation application service company is a partnership agreement as regulated in civil law. However, in practice the existing legal regulations have not provided legal protection to drivers of online transportation because not all drivers of online transportation understand their position as a partnership relationship. If it is associated with civil law, this is contrary to the principle of balance; it can even be said to be an abuse of the situation (misbruik van omstadigheden). The misuse of this situation can occur if an agreement is born due to economic excellence, psychological superiority and other advantages. The purpose of this study is to see how existing legal regulations actually runs effectively and efficiently in the community. The method of this research is qualitative research, namely based on the principles of law, doctrine and legislation that can answer the problems of this study. Keywords : Partnership Agreement, Driver, Online Transportation

Abstract

Law as a means of controlling social behavior in society was created to fulfill a sense of security, comfort, welfare and justice in daily social interactions in the community. Therefore a legal strategy is needed in order to create universal legal protection. This universal protection is contained in various laws and regulations in Indonesia. However, the implementation of regulations contained in various forms of legislation that should provide universal legal protection has not been implemented as expected, one of which is the lack of attention regarding the protection of female workers who work in the UMKM sector, especially in Medan City. This research aims to examine various forms of legal instruments, both international and domestic which regulate legal protection for female workers, and see the extent to which the relevant factions have done so that the effectiveness of these legal instruments can truly provide universal protection, especially for women workers. female workers whose source of income comes from the UMKM sector in the city of Medan. The qualitative method in this research is used by using the basic concept of law, the essential of various statutory rules, and dogmas that can produce solutions in this study. The results of this research indicate that in its implementation of legal protection for female workers, especially in the UMKM sector in the city. Medan is still far from expectations, it can be seen from the emergence of various cases in the community related to female labor. However, in order to overcome this problem, Indonesia actually has various legal instruments, both national and international, which are contained in various laws and regulations that have even existed since the period of the kingdom until now. In order to fulfill legal protection for female workers in the UMKM sector, especially in the city of Medan, it involves many related parties, such as the Government, Employers / Associations, NGOs (Non-Government Organizations) and the community. The efforts made by these parties are essentially the implementation of various forms of policies and programs related to the supervision and implementation of protection for female workers, especially in the UMKM sector.
