Abstract

ABSTRAKKondotel merupakan bangunan yang menggabungkan karakter kondominium dan hotel, yang dapat dihuni dengan dikelola menggunakan sistem hotel. Namun, pada praktiknya, terdapat pengembang yang dinyatakan pailit dan mengakibatkan unit kondotel dimasukkan kedalam harta pailit pengembang. Sebelum pengembang dinyatakan pailit, para pembeli telah melakukan serah terima unit dengan pengembang dan telah melakukan penandatanganan Akta Jual Beli dihadapan Pejabat Pembuat Akta Tanah. Penelitian ini menggunakan metode pendekatan yuridis-normatif, dengan data dianalis secara yuridis-kualitatif dan spesifikasi penelitian adalah deskriptif-analisis. Hasil penelitian menunjukkan bahwa Akta Jual Beli yang telah ditandatangani oleh para pembeli, peralihan haknya telah terjadi. Hak milik atas unit kondotel Jimbaran View Bali telah beralih menjadi milik para pembeli, sehingga tidak seharusnya unit kondotel dimasukkan kedalam harta pailit pengembang. Untuk melindungi para pembeli akibat ditolaknya permohonan pendaftaran peralihan hak untuk balik nama Sertifikat Hak Milik Satuan Rumah Susun oleh Kantor Pertanahan, para pembeli dapat mengajukan gugatan kepada pihak Kantor Pertanahan di Pengadilan Tata Usaha Negara Denpasar, karena mengakibatkan unit kondotel Jimbaran View Bali milik para pembeli dimasukkan kedalam harta pailit pengembang.Kata kunci: akta jual beli; harta pailit; kondotel. ABSTRACTCondotel combines the characteristics of a condominium and a hotel in one building, hence its units can be purchased and owned individualy, but still be operated like a hotel. Buyers hold the rights of ownership to their purchased units, yet there are cases where the developer of the condotel is declared bankrupt and the condotel is listed as its bankruptcy assets. That condition happened despite the fact that before being declared bankrupt, the units has been handovered by the developer to the buyers, and both parties have signed The Sale and Purchase Deed in front of a Land Deed Official. This article will talk about the case of Jimbaran View Bali Condotel, where said condition occurred. The study in this article was done using juridical-normative approach, the data was analyzed using juridical-qualitative method, and the specification of this study is descriptive-analysis. The findings show that the transfer of rights has happened, marked by the signing of The Sale and Purchase Deed by both parties. Buyer’s ownership of Jimbaran View Bali Condotel units are legitimate, yet the curator still listed the condotel as the developer’s bankruptcy assets. To protect themselves, the buyers whose rights of ownership are denied by the National Land Agency can file a lawsuit in Denpasar Administrative Court against the National Land Agency because of their stipulation caused for listing their units in Jimbaran View Bali Condotel as the developer’s bankruptcy assets.Keywords: the sale and purchase deed; bankruptcy assets; condotel.
