Abstract

The growth of Islamic matrimonial system in the present Indonesia was originally formulated in the 19th century of the Netherlands colonialism. There are several discourses among Dutch scholars in establishing an applicable law system since there are various legal system existed, and finally the colonial government issued legal dualism in order to preserve their hegemony. Provoked by several scholars the new constitution in 1854 was approved. In that, the Islamic matrimonial system was assimilated into Adat law and therefore the Islamic marriage system was allowed to be practiced in its own way. This Islamic matrimonial system was formed as a law under Dutch controls. Accordingly, the paper discusses Dutch hegemony system through applicable Islamic matrimony, and the development of this marriage as the formation of preserving hegemony. This paper arguably investigates Dutch hegemony system through applicable of Islamic matrimony. The analysis is guided by following questions: first, what are the reasons behind the implementation of indigenous legal institution such as Islamic marriage in preserving hegemony? Second, to what extent does the Islamic matrimony persisted within the applicable policy? The methodology is critical analysis of legal history contents, the data mainly taken from legal manuscripts which is a comprehensive view of law from a particular critical vantage point: a way of doing law, perhaps doing things with law. This paper argued that Dutch Hegemony system is poles apart from many colonialism regimes, the incorporated of indigenous legal system has become a method to subjugate indigenous power. Therefore, Islamic Matrimony developed into ways according to colonial’s interest

Abstract

Abstrak Pernikah akan sah apabila terpenuhi unsur-unsur: (1) adanya mempelai laki-laki dan perempuan. (2) Adanya dua orang saksi, (3) adanya wali, dan (4) aqad atau ijab kabul. Dalam unsur-unsur tersebut tidak disebutkan kewajiban terdaftar atau memiliki buku nikah yang dikeluarkan Kantor Urusan Agama (KUA). Atas dasar ini, sebagian kalangan yakin bahwa nikah secara sirri adalah sah. Muncul ungkapan dalam masyarakat yang berbunyi: “yang penting sah menurut agama”. Dalam ungkapan ini terkesan, nikah adalah urusan agama dan hanya perlu mematuhi aturan yang ada dalam agama, sehingga tidak berdosa kepada Allah. Dengan demikian muncul anggapan akan kebolehan menafikan ketentuan tambahan yang dibuat oleh manusia. Ketentuan nikah di hadapan pegawai KUA dan memiliki buku nikah hanya syarat tambahan tersebut. Jadi sekiranya tidak memiliki tambahan tersebut nikah tetap dianggap sah. Sejatinya masalah pernikahan bukan hanya sekedar sah saja, namun juga harus melihat dari perpektif lain, yaitu pengakuan oleh negera dalam bentuk dokumen atau akta pernikahan. Suatu fakta persolan yang masih terjadi dalam masyarakat adalah masih banyaknya perkawinan yang tidak tercatat yang berakibat tidak adanya bukti perkawinan yang sah.

Abstract

The debate regarding Omnibus Law as the main means for structuring legal regulations in Indonesia attracted a lot of public attention when the Omnibus Law method, which was previously little known in Indonesia as a country that adheres to the Continental European legal system, was used in the preparation of draft laws (RUU). How does the constitutional transition to the establishment of an omnibus law on copyright work in a democratic country? How do we review the constitutionality of the implementation of the Omnibus Law and the copyright mechanism in the formation of statutory regulations? This research uses the concept of normative descriptive research, or what can be called normative juridical research. With this method, law is interpreted as what is written in legislation (law in a book), or law is interpreted as a legal rule, which is a standard for appropriate behavior. The Omnibus Law method practiced in the common law system is interpreted as a (new) law that regulates various kinds of regulations to simplify the various laws that are still in force. Constitutionally, the legal position of the omnibus law concept has not been regulated in the legal system or in the laws and regulations in Indonesia. Law No. 11 of 2020 concerning Job Creation, which was formed using the Omnibus method, is considered to be constitutionally contradictory because it does not have clear objectives and formulation, both in terms of the standard of formation, the systematics of its creation, and the process of changing its substance.
