<![CDATA[Abstract The existency of Land Seal becomes a special issue in Balikpapan City. The happening is about the overlapping of the owners of multiple property rights upon one land object. With the assisstance of Balikpapan Major Circulars NO 591/2060/Prthn-Perkot/2011 based on Regional Regulation NO 1 in 2014 about The Permission To Clear State Land (IMTN), it is stated that every person should firstly request his/her Land Seal to be changed into IMTN, as the requisite to upgrade the status of the land to the BPN (National Land Agency).This IMTN will not be issued if there is the claim/law suit from the third party. Therefore, the citizens who own the Land Seal feel that they are lack of law protection toward the land seal they have before. This article/journal has purpose to anayze the existency of the certificate of IMTN which could be changed as the replacement of the land seal aso to formulate the law protection rules for the rights owner of the Land. The research design used in this study is juridical empirical by using juridical sociology approach to analyze the problem related to the existency of IMTN certificate as the replacement of land seal in Balikpapan City which is used as the basic to upgrade the status of the land into certified land. By applying the Regional Regulation and Balikpapan Major Circulars is actually the form of innovation of local government as the effort to minimize the problem of the overlapping of Land Seal, it ias also as the protection law that could be done preventively, by doing supevision on the existency of Land Seal in the issuing of IMTN certificate, also repressively, as the effort to do the deliberation to get agreement. If this deliberation does not work, then, the claim could be proposed to the court to get the incracht decision. Key words: law protection, land seal, IMTN (The Permission to Clear State Land) Abstrak Keberadaan segel tanah menjadi permasalahan pertanahan tersendiri di Kota Balikpapan. Permasalahannya yakni tumpang tindih pemegang hak atas tanah ganda dalam satu obyek tanah. Dengan surat edaran Walikota Balikpapan Nomor 591/2060/Prthn-Perkot/2011 berdasarkan Peraturan Daerah Nomor 1 Tahun 2014 tentang Izin Membuka tanah Negara maka tiap orang wajib memohonkan segel tanah menjadi surat keterangan Izin membuka tanah negara (IMTN) terlebih dahulu, untuk syarat meningkatkan status hak kantor pertanahan. Surat keterangan Izin Membuka Tanah Negara tersebut tidak dapat terbit apabila ada sanggahan dari pihak ketiga, untuk itu masyarakat merasa kurang mendapatkan perlindungan terhadap segel tanah yang mereka miliki sebelumnya. Jurnal ini bertujuan untuk menganalisis eksistensi surat keterangan IMTN sebagai pengganti segel tanah dan merumuskan bentuk-bentuk perlindungan hukum bagi pemegang hak atas tanah. Jenis penelitian yang digunakan adalah penelitian yuridis empiris dengan pendekatan yuridis sosiologis untuk mengkaji persoalan segel tanah terkait keberadaan surat keterangan IMTN sebagai pengganti segel tanah di Kota Balikpapan yang dipakai sebagai dasar untuk meningkatkan status hak menjadi sertifikat. Sehingga dengan Peraturan Daerah dan surat edaran tersebut merupakan bentuk inovasi pemerintahan daerah untuk dapat meminimalisir terjadinya tumpang tindih segel tanah, serta bentuk perlindungan hukum yang dapat dilakukan secara preventif, dengan melakukan pengawasan terhadap keberadaan segel tanah dalam penerbitan surat keterangan IMTN dan secara represif dilakukan musyawarah mufakat, jika musyawarah tidak berhasil maka dilanjutkan gugatan ke pengadilan untuk mendapatkan putusan yang incracht.  Kata kunci: perlindungan hukum, segel tanah, Izin Membuka Tanah Negara                             (IMTN)]]>
