Abstract

Abstract This study discussed the vagueness of Article 4 paragraph (2) (a and b) of the Marriage Act. This study aims to discover and analyze the criteria referred to in Article 4 paragraph (2) (a and b) of the Marriage Act, and the criteria that found will be determined its juridical constructions. The method used in this research is Normative Juridical with legislation approach, case approach, and concept approach. Legal materials will be analyzed using qualitative descriptive technique and the description in tabular form by comparing the perception of judges, experts, and consideration of the judge (verdict) will be analyzed qualitatively using textual interpretation. The study found that criteria of Article 4 paragraph (2) (a and b) of Marriage Act was the wife aged and very weak that it cannot perform its obligation as a wife, the misbehave wife, and the wife cannot serve and balance the biological needs of the husband. The criteria of Article 4 paragraph 2 (a and b) was (a) the wife of any dangerous and contagious diseases, (b) the wife of diseases that result in disruption of biological relationship between the couple, (c) the wife of diseases that result in less or non-functioning part of the body, (d) those illness in point (a), (b), and (c) is difficult and/or cannot be cured even if had been treated medically, (e) the illness of wife in point (a), (b), and (c) must be evidenced by a Medical Certificate. For juridical construction, criteria were found subsequenly formulated into the form of act and placed on the explanation of Marriage Act. Key words: vagueness, Marriage Act, juridical contructions Abstrak Penelitian ini membahas mengenai kekaburan pasal 4 ayat (2) huruf (a dan b) Undang-Undang Perkawinan. Penelitian ini bertujuan untuk menemukan serta menganalisis kriteria yang dimaksud dalam pasal 4 ayat (2) huruf (a dan b) Undang-Undang Perkawinan, dan setelah ditemukan kriterianya maka akan ditentukan konstruksi yuridisnya. Metode yang digunakan dalam penelitian ini adalah Yuridis Nomatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konsep. Bahan hukum akan dianalisis menggunakan teknik deskriptif kualitatif, deskripsinya dalam bentuk tabel dengan membandingkan antara persepsi hakim, para ahli, dan pertimbangan hakim (putusan) yang akan dianalisis secara kualitatif dengan menggunakan penafsiran tekstual. Hasil penelitian menemukan bahwa kriteria pasal 4 ayat (2) huruf (a) Undang-Undang Perkawinan adalah istri berusia lanjut dan kondisinya sangat lemah sehingga tidak dapat melakukan kewajibannya sebagai istri, istri berkelakuan buruk, istri tidak dapat melayani dan mengimbangi kebutuhan biologis suami. Kriteria pasal 4 ayat (2) huruf (b) adalah (a) istri mengidap penyakit yang berbahaya dan menular, (b) istri mengidap penyakit yang berakibat terganggunya hubungan biologis antara pasangan suami istri, (c) istri mengidap penyakit yang berakibat kurang atau tidak berfungsinya bagian anggota tubuh, (d) penyakit yang diderita istri pada huruf (a), (b), dan (c) tersebut sulit dan/atau tidak dapat sembuh walaupun telah diobati secara medis, (e) penyakit yang diderita istri pada huruf (a), (b), dan (c) tersebut harus dibuktikan dengan Surat Keterangan Dokter. Untuk Konstruksi yuridisnya, kriteria yang ditemukan selanjutnya diformulasikan ke dalam bentuk Undang-Undang dan diletakkan pada bagian penjelasan Undang-Undang Perkawinan. Abstract

This research intends to investigate the work culture, constraints, and efforts to overcome constraints of personnel work culture at the Cleanliness Division of Market and Street Vendor Samarinda City Office. It is a descriptive, quantitative research. The research variable is the personnel work performance which comprises two indicators: attitude toward jobs and attitude toward work hours. The population is 30 people and 28 of them become the samples of this research. The data are gathered through literature study and field research by means of questionnaire, interview and direct observation. The data are then analyzed through importance-performance analysis. The research result shows that 95,42% respondents consider work culture “very important” and 75,37% respondents appraise it in “good category”. Based on this result, the writer recommends that: (a) two-way communication between the leaders and staff should always be conducted and the meetings among units / sub-units should be optimized; (b) leaders should send their staff to trainings or workshop related to cleanliness services; and (c) leaders should regularly evaluate the work culture effectiveness and efficiency.
