Fakultas Hukum Universitas Brawijaya Email: Rifkybakhtiar35@gmail.com ABSTRAK Aturan mengenai pendaftaran tanah telah di atur dalam Peraturan Pemerintah Republik Indonesia Nomor 24 tahun 1997 bahwa seluruh masyarakat Indonesia diwajibkan untuk mendaftarakan tanahnya guna mendapatkan suatu kepastian hukum. Kepastian hukum akan kepemilikan tanah ialah salah satu kepastian hukum yang wajib ditindaklanjuti. Dari adanya permasalahan tersebut, pemerintah semakin fokus dalam menindak lanjuti pendaftaran tanah. Hal tersebut dikarenakan pentingnya kepemilikan sertifikat merupakan alat bukti yang kuat akan kepemilikan tanah dan legalisasi yang sah menurut undang-undang yang berlaku. Arus ekonomi yang terjadi di Desa Kembangbilo dapat dikatakan cukup efektif dan masyarakatnya merupakan masyarakat kalangan menengah kebawah. Berdasarkan permasalahan yang terjadi di Desa Kembangbilo Kabupaten Tuban, ditemukan beberapa masalah tentang pendaftaran tanah yang kurang efektif, terdapat 70% penduduk yang masih belum mendaftarkan tanahnya dan 30% telah terdaftar. Hal tersebut dapat dipastikan bahwa undang-undang yang dibuat oleh pemerintah kurang efektif terhadap masyarakat Desa Kembangbilo. ABSTRACT The Regulation of Government Regulation of the Republic of Indonesia Number 24 year 1997 on the Land Registry in which the entire people of Indonesia are required to register their lands in order to obtain legal certainty. The ownership of land is one of the legal certainties which must be followed up. Due to the existence of these problems, the government has increasingly focused on following up land registration. That is because the certificate of ownership is a strong evidence of ownership of land and legalization that is valid under applicable law. The economic currents that occurr in the village of Kembangbilo can be quite effective and the people of that village are of middle-classcategory. Based on the problems that occurred in the village of Kembangbilo Tuban, several problems were found concerning the ineffectiveness of land registration in which the 70% of the population still did not register their land while the rest did. Â It can be ascertained that the laws made by the government is less effective against Kembangbilo Village community.
