Fakultas Hukum Universitas Brawijaya Email: ricoandrianh@gmail.com  Abstrak Penelitian membahas permasalahan tentang kekaburan hukum dalam Pasal 41 (C) (i) Peraturan Pemerintah Nomor 1 Tahun 1975 tentang Pelaksanaan Undang-Undang Perkawinan. Kata “penghasilan†dalam pasal tersebut menjadi letak permasalahan, dimana tidak ada penjelasan secara jelas tentang sejauhmana pemaknaan penghasilan. Berdasarkan hal tersebut, masalah yang dirumuskan yaitu apa makna penghasilan dalam Pasal 41 (C) (i) Peraturan Pemerintah Nomor 9 Tahun 1975 tentang Pelaksanaan Undang-Undang Perkawinan sebagai syarat izin poligami? Hasil penelitian menunjukan bahwa makna penghasilan dalam Pasal 41 (C) (i) Peraturan Pemerintah Nomor 9 Tahun 1975 tentang Pelaksanaan Undang-Undang Perkawinan sebagai syarat izin poligami adalah seluruh harta kekayaan yang dimiliki oleh suami yang hendak berpoligami. Seluruh harta kekayaan yang dimaksud disini ialah baik berupa bukti kepemilikan benda bergerak, maupun benda tetap, dan juga termasuk di dalamnya gaji.  Kata kunci: makna penghasilan, poligami THE MEANING OF INCOME IN SECTION 41 (C) (i) GOVERNMENT REGULATION TO REPLACE THE LAW NUMBER 9 YEAR 1975 ABOUT THE IMPLEMENTATION OF MARRIAGE LAW AS THE REQUIREMENT FOR POLYGAMY PERMISSION  Rico Andrian Hartono, Dr. A. The word “income†in this section becoming the core of the problem. That’s why the researcher rise a problem of statement that will be discuss more. The researcher would like to find out what the meaning of “income†in section 41 (C) (i) government regulation to replace the law number 9 year 1975 about the implementation of marriage law as the requirement of polygamy permission is. The result of the research show that the meaning of “income†in section 41 (C) (i) government regulation to replace the law number 9 year 1975 about the implementation of marriage law as the requirement of polygamy permission is the whole riches that belongs to the husband who want to do polygamy.
