Abstract

Fakultas Hukum Universitas Brawijaya Email: yudhaadiwirabawa@gmail.com Abstrak Pengangkutan umum menggunakan bus selain mengangkut penumpang juga mengangkut barang bawaan penumpang. Seringnya terjadi kasus mengenai barang bawaan penumpang yang rusak, hilang, atau tertukar memunculkan pertanyaan mengenai tanggung jawab Perusahaan Otobus terhadap barang bawaan penumpang di dalam bagasi. Tujuan dari penelitian ini adalah Untuk mengetahui serta menganalisis mengenai tanggung jawab Perusahaan Otobus atas bawang bawaan penumpang dalam bagasi ketika terjadi kehilangan, kerusakan atau tertukar pada saat pelaksanaan pengangkutan. Jenis penelitian ini merupakan jenis penelitian empiris dengan metode pendekatan yuridis-empiris. Berdasar hasil penelitian diperoleh kesimpulan bahwa Perusahaan Otobus Gunung Harta bertanggung jawab terhadap barang bawaan penumpang, namun hanya yang di letakkan di bagasi bus saja, sedangkan barang penumpang yang di bawa ke kabin penumpang bukan merupakan tanggung jawab perusahaan. Adanya klausula eksonerasi dalam perjanjian tiket bus, membuat kerancuan dalam hal terjadi kejadian hilang, rusak atau tertukarnya barang bawaan penumpang di bagasi bus, karena klausa tersebut tidak menyatakan jelas mengenai tanggung jawab perusahaan yang sesungguhnya terhadap barang bawaan penumpang. Frequent cases of damaged, lost, or get excidentally exchanged the passanger’s luggage make the passangers repeatedly ask questions about the responsibility of the Otobus company to passenger luggage in the bus baggage. The purpose of this research was to determine and analyze the Company's responsibility on passenger’s luggage in the baggage when the event of loss, damage or get excidentally exchanged at the time of the transport. This type of research is a kind of empirical research with empirical juridical approach. Based on the research results we concluded that the Gunung Harta Otobus Company responsible for passenger luggage, but only luggage that placed in the bus baggage only, while passenger’s goods brought into the passenger cabin is not the responsibility of the company.
