<![CDATA[Fransiska Louisa Mbula, Warkum Sumitro, SH., MH., Ratih Dheviana Puru H, SH.LLM Fakultas Hukum Universitas Brawijaya Email : fransiskalouisa998@gmail.com  Abstrak Penelitian ini membahas kekaburan hukum pada Pasal 27 ayat (1) tahun 1974 Undang-Undang Nomor 1 Tahun 1974 mengenai pembatalan perkawinan di bawah ancaman yang melanggar hukum. Berdasarkan hal tersebut, masalah yang dirumuskan terkait bentuk dan sifat ancaman dalam pembatalan perkawinan serta kepastian hukumnya pembatalan perkawinan di bawah ancaman yang melanggar hukum dalam Pasal 27 ayat (1) Tahun 1974. Berdasarkan hasil penelitian bahwa sifat ancamannya adalah menimbulkan rasa takut, tidak berdaya, dan tidak mampu bertindak, kemudian untuk bentuk ancamannya yaitu perbuatan kekerasan tanpa senjata yang pada dasarnya menyerang secara psikis. Dan untuk kepastian hukum berdasarkan hasil penelitian menggunakan teori kepastian hukum Lon L. Fuller bahwa pasal 27 ayat (1) Undang-Undang Pasal 27 ayat (1) tidak memenuhi salah satu prinsip kepastian hukum yaitu adanya kegagalan dalam menciptakan aturan hukum yang bisa dimengerti sehingga menimbulkan multitafsir, dikarenakan pasal tersebut tidak menjelaskan sifat dan bentuk ancaman sebagai salah satu alasan diajukannya pembatalan perkawinan sehingga terjadinya multitafsir.  Kata kunci : Ancaman yang melanggar hukum, pembatalan perkawinan di bawah ancaman yang melaggar hukum. LEGAL CERTAINTY OF ARTICLE 27 PARAGRAPH (1) OF LAW NUMBER 1 YEAR 1974 ABOUT THE REASONS FOR MARRIAGE CACNCELLATION UNDER THREAT THAT IS AGAINST THE LAW  Fransiska Louisa Mbula, WarkumSumitro, SH., MH.,Ratih Dheviana Puru H, SH.LLM Faculty of LawUniversitasBrawijaya Email : fransiskalouisa998@gmail.com  Abstract This study discussed the vagueness of law of article 27 paragraph (1) year 1974 of Law number 1 year 1974 about marriage cancellation under threat which is againts the law. Thus, the research problems formulated are concerning the form and nature of threat in marriage cancellation and also the legal certainty of marriage cancellation under threat which violates the law contained in article 27 paragraph (1) year 1974. The results of the study show that the nature of the threat ignites fear and helplesness. The form of the threat is violence without involving gun which affects psychologically. In terms of legal certainty, this study using the theory of legal certainty by Lon L.Fuller reveals that article 27 paragraph (1) of Law does not comply with one of the legal principles that is the presence of failure in creating new rule which can be comprehended which then leads to multi-interpretation. It is so as the article does not provide explanation on the nature and form of threat as one of the reasons for the proposal for marriage cancellation.  Keywords: threat that is against the law, marriage cancellation under threat that is against the law ]]>
