Fakultas Hukum Universitas Brawijaya Email: mahmudnabils@gmail.com Abstrak Dalam pasal 15 ayat 4 Keputusan Menteri Tenaga Kerja dan Transmigrasi Nomor 100 Tahun 2004 diatur bahwa pembaharuan perjanjian kerja waktu tertentu tanpa melalui masa tenggang 30 hari menjadikan perjanjian kerja waktu tertentu berubah menjadi perjanjian kerja waktu tidak tertentu. Perlu dikaji apakah makna kata berubah pada pasal tersebut demi menjamin kepastian hukum. Penelitian ini dilakukan dengan metode yuridis-normatif. Hasil penelitian ini menyimpulkan bahwa pasal tersebut belum menjamin kepastian hukum karena masih belum memberikan penjelasan terkait makna kata berubah beserta dengan proses perubahannya. Oleh karena itu diperlukan pembaharuan hukum dengan jalur regulasi peraturan yang didasarkan pada prinsip kepastian hukum. THE MEANING OF THE WORD “CHANGE†RELATED TO THE RENEWAL OF FIXED TERM EMPLOYMENT CONTRACT WHICH IS NOT EXCEEDING 30 DAYS OF GRACE PERIOD (A study on Article 15 paragraph 4 of the Minister of Manpower and Transmigration Number 100 year 2004 about the Provision of The Implementation of Fixed Term Employment Contract.) In the word of “berubah†should be digging more about the meaning of it to make sure the legal certainty. This research is using Juridical – normative method. And the result is study indicates that article has not guaranteed the legal certainty because doesnt giving explanation in the word of “berubah†and also the process inside of it.
