Fakultas Hukum Universitas Brawijaya ABSTRAK Kajian sejarah yang mengarahkan terhadap pemenuhan kebutuhan masyarakat desa baik sekitar maupun dalam hutan melalui pemindahan konsep pengelolaan hutan berbasis Negara (State Base Developement) menjadi pengelolaan hutan berbasis desa (Communitiy Base Developement) melahirkan bentuk Perhutanan Sosial (Social Foresty) yang mencoba mengambil peran untuk mengakomodir keinginan, hasrat dan harapan masyarakat dalam pengelolaan hutan. Bentuk dari perhutanan social ini salah satunya adalah hutan desa, namun sayangnya pengaturan terkait dengan hutan desa khususnya LPHD dianggap masih terjadi disharmonisasi serta kekaburan dalam subtansinya yang menyebabkan ketidakjelasan kedudukan LPHD maupun bagaimana proses pembentukan LPHD sendiri. Maka penulis melalui metode penelitian normative berusaha memberikan gambaran rekonstruksi pemilihan anggota lembaga pengelolaan hutan desa (LPHD) dan bentuk rekonstruksi kedudukan LPHD.  Kata Kunci : Hutan Desa, LPHD, Masyarakat Desa  RECONSTRUCTION OF VILLAGE FOREST MANAGEMENT INSTITUTION (VFMI) IN THE MANAGEMENT OF VILLAGE FOREST Mohamad Rif’an, Herlin Wijayanti., SH., MH, Dr. Imam Koeswahyono, SH., MH. Faculty Of Law Brawijaya University ABSTRACT Historical review leaning to the fulfilment the needs of village residents residing around or inside the forest through the shift from state-based development to communite based development brings out the form of social forestry which serves to accommodate the ecpectation and desire of the communitu on managing the forest. One of the forms of social forestry is village forest. Unfortunately, the regulation concerning village forest especially VFMI is stil bague and mismatches in its sibtance which lead to the onscurity of the VFMI’s position and the establishment of the reconstruction of the election for the member of VFMI and the form of position reconstructuin in VFMI.
