Fakhriyah Nisrina, Dr. Budi Santoso, S.H., LL.M., Ratih Dheviana Puru HT, S.H., LL.M.fakhriyahnisrina@yahoo.co.id ABSTRAKPada penelitian ini, penulis menganalisis permasalahan mengenai kesesuaian pengaturan kenaikan iuran jaminan kesehatan dengan prinsip-prinsip penyelenggaraan jaminan sosial terkait dikeluarkannya Peraturan Presiden Nomor 19 Tahun 2016. Kenaikan iuran jaminan kesehatan dinaikkan hanya untuk Peserta Bukan Penerima Upah atau Peserta Mandiri dan Peserta Bukan Pekerja. Pemilihan tema dalam penelitian ini dilatar belakangi oleh Peraturan Presiden Nomor 19 Tahun 2016 Tentang Perubahan Kedua Atas Peraturan Presiden Nomor 12 Tahun 2013 Tentang Jaminan Kesehatan. Permasalahan ini timbul akibat adanya penyesuaian iuran Badan Penyelenggara Jaminan Sosial Kesehatan. Penyesuaian iuran menimbulkan adanya Pro dan Kontra ditengah masyarakat. Salah satu pihak yang Proaktif tidak mempermasalahkan dengan adanya kenaikan iuran tersebut karena untuk kesehatan dengan syarat adanya pengoptimalan pelayanan, sedangkan pihak yang Kontra dengan kenaikan iuran ini berpendapat bahwa beberapa prinsip penyelenggaraan jaminan sosial terpenuhi tetapi yang mampu menyubsidi pendapatannya kurang. Penelitian ini menggunakan jenis penelitian yuridis normatif dengan menggunakan pendekatan Statue Aprroach. Bahan hukum yang digunakan pada penelitian ini dilakukan melalui interpretasi, yakni interpretasi gramatikal. Berdasarkan hasil pembahasan, diperoleh hasil bahwa Pеrаturаn Prеsidеn Nomor 19 Tаhun 2016 Tеntаng Jаminаn Kеsеhаtаn mеmiliki kеsеsuаiаn dеngаn 3 (tigа) prinsip pеnyеlеnggаrааn jаminаn sosiаl yаitu: Prinsip Kеpеsеrtааn Wаjib, Prinsip Nirlаbа, Prinsip Kеgotong-royongаn. Pеrаturаn prеsidеn tеrsеbut jugа tеlаh tеpаt gunа pеnyеsuаiаn dаsаr kеbutuhаn mаsyаrаkаt dеngаn pеnyеlеnggаrааn jаminаn sosiаl nаsionаl.Kata Kunci: Kesesuaian, Jaminan Kesehatan, Prinsip Jaminan Sosial, Iuran, Asuransi SosialABSTRACTThis study discussed the suitability of the arrangmenet on the increase of health insurance fee with the principle of the social security administration related with the issuance of Presidential Regulation number 19 year 2016. The increase of health insurance fee is only subjected for non-wage earners or independent participant and the non-worker participant. Ths topic was chosen due to the issuance of Presidential Regulation number 19 year 2016 about the second amandement of Presidential Regulation number 12 year 2013 about Health Insurance. This issue surfaced due to the adjustment of fee set by the administrator of Health Social Security. This adjustment triggered pro and contra from the society. The pros believed that the increase on the fee was not a problem as long as the service in health would be improved while the cons thought that even though the principles of social security had een met, the ones who gave subsidy had less earnings. This study used normative juridical method with statute approach. The legal materials involved in this study were obtained through grammatical interpretation. The results of the study show that the Presidential Regulation number 19 year 2016 about Health Insurance has three conformities with 3 (three) principles of social security administration, which are: the principles of compulsary membership, non-profit, and mutual help. That Presidential Regulation is also appropriate to meet the basic needs of the society by means of the administration of national social security.Keywords: Suitability, Health Insurance, The Principle of social security, Fee, Social securityÂ
