Abstract

Lely Mahartina K.U, Agus Yulianto, SH.MH, Dr.Herman Suryokumoro,SH.MS Fakultas Hukum Universitas Brawijaya Email : lely_artina@yahoo.com   ABSTRAK Pemilihan judul tersebut dilatarbelakangi oleh adanya permasalahan di Kabupaten Ponorogo menyangkut Kasus Kendaraan Dinas Operasional Anggota DPRD yang harus dikembalikan berkaitan dengan adanya Penerimaan Tunjangan Transportasi berdasarkan Pasal 27 Peraturan Daerah Kabupaten Ponorogo Nomor 5 Tahun 2017 tentang Hak Keuangan Administratif Pimpinan dan Anggota DPRD, bahwa Anggota DPRD disediakan dua pilihan yakni Jika sudah disediakan Kendaraan dinas operasional, maka Anggota DPRD Kabupaten Ponorogo tidak mempunyai hak atas Tunjangan Transportasi. Hal tersebut berlaku sebaliknya.Dalam kasus tersebut Anggota DPRD Ponorogo yang sudah menerima Tunjangan Transportasi Harus mengembalikan Kendaraan Dinas Operasional. Untuk Pimpinan DPRD tidak adanya keharusan pengembalian terkait kendaraan dinas yang diterima,karena Hak Protokoler yang melekat pada jabatan Pimpinan DPRD Ponorogo tersebut. Rumusan Masalah dalam penelitian ini adalah (1) Apakah Pelaksanaan Pengembalian Kendaraan dinas operasional Anggota DPRD  pasca diterimanya tunjangan transportasi sudah sesuai dengan Pasal 27 Peraturan Daerah Kabupaten Ponorogo Nomor 5 Tahun 2017 ? (2) Bagaimana Konsekuensi Hukum dari Pengembalian Kendaraan dinas operasional Anggota DPRD pasca diterimanya tunjangan transportasi terhadap  Pasal 27 Peraturan Daerah Kabupaten Ponorogo Nomor 5 Tahun 2017 ? Jenispenelitian yang digunakan adalah Yuridis empiris,metode pendekatan yang digunakan adalah yuridis sosiologis.Penelitian dilakukan di Sekretariat DPRD dan Badan Pendapatan Pengelolaan Keuangan dan Aset Daerah Kabupaten Ponorogo. Dari hasil penelitian diketahui bahwa belum adanya kesesuaian antara kenyataan yang terjadi dilapangan dengan penerapan Pasal 27 Peraturan Daerah Kabupaten Ponorogo Nomor 5 Tahun 2017 tentang Hak Keuangan dan Administratif  Pimpinan dan Anggota DPRD. bagi Anggota DPRD Pemberian Kendaraan Dinas harus segera dikembalikan kepada Pemerintah Daerah terkait adanya penerimaan Tunjangan Transportasi. Berdasarkan hal diatas sosialisasi akan Perda tersebut rupanya belum terlaksana dengan baik. Pengembalian kendaraan operasional tersebut mempunyai Konsekuensi hukum baik terhadap Anggota DPRD Kabupaten Ponorogo maupun status Kendaraan Dinas operasional Anggota DPRD Ponorogo. Kata Kunci : Pengembalian, Kendaraan Dinas Anggota DPRD, Tunjangan Transportasi ABSTRACT The title is based on an issue arising in the Regency of Ponorogo regarding official vehicles used for operational purposes by members of Regional House of Representatives (further stated as DPRD). The official vehicles must be returned as transport allowance is given by DPRD. According to Article 27 of Regional Regulation of the Regency of Ponorogo Number 5 Year 2017 on Administrative Financial Rights of Heads and Staff of DPRD, the heads and staff of DPRD are not supposed to be allowed to use official vehicles when the transport allowance is provided or vice versa. In this case, the members of DPRD of Ponorogo who receive transport allowance must return official vehicles, while the heads of DPRD are not obliged to return the official vehicles as they hold official right due to their position. Research problems involve: (1) is returning official vehicles used for operational purposes by members of DPRD when transport allowance is given relevant to Article 27 of Regional Regulation of the Regency of Ponorogo Number 5 Year 2017?(2) What are the legal consequences of returning official vehicles used for operational purposes by the members of DPRD as transport allowance is given regarding Article 27 of Regional Regulation of the Regency of Ponorogo Number 5 Year 2017? Juridical-empirical research method was employed in this research with socio-juridical approach. This research took place in Secretariat of DPRD and Regional Asset and Financial Management and Revenue Agency of the Regency of Ponorogo. From this research, it was found that there is no relevance between what has happened in reality and the implementation of Article 27 of Regional Regulation of the Regency of Ponorogo Number 5 Year 2017 on Financial and Administrative Right of heads and Members of DPRD. For the members of DPRD, official vehicles must immediately be returned to local government regarding the transport allowance received by the members. It shows that the Regional Regulation has not been appropriately implemented. This certainly brings legal consequences for both the members of DPRD of the Regency of Ponorogo and the official vehicles used for operational purposes by the members of DPRD of Ponorogo. Abstract

Bureaucratic reform is a strategic agenda to realize a clean, transparent, and accountable government. In the context of Indonesia Emas 2045, the success of bureaucratic reform largely depends on the effectiveness of administrative law as an instrument of regulation, oversight, and legitimacy for governmental actions. This study examines how administrative law strengthens democratic consolidation through bureaucratic reform. This research employs a normative juridical method using statutory and conceptual approaches. The legal materials analyzed include primary legal sources (the 1945 Constitution, the Administrative Procedure Act, the Civil Service Act, and regulations related to bureaucratic reform and governance), secondary legal materials (scholarly literature, journals, and policy documents), and tertiary sources. The analysis is conducted qualitatively and descriptively, focusing on aspects of authority, accountability, and administrative control mechanisms within the framework of democracy toward 2045. The findings indicate that an effective model of administrative law requires strengthening democratic and accountable legal norms, reforming regulatory frameworks, and optimizing both internal and external control mechanisms. Without a solid administrative law foundation, Indonesia will face significant obstacles in realizing meaningful bureaucratic reform for the 2045 vision. This study concludes that bureaucratic reform requires an administrative law framework that is democratic, participatory, and responsive. Without a strong legal foundation, bureaucratic transformation will struggle to produce accountable and citizen-oriented governance. Strengthening administrative law is therefore a key pillar for achieving democratic consolidation and the broader agenda of Indonesia Emas 2045.
