<![CDATA[Rizky Dewanata, Sudarsono, Lutfi Effendi Fakultas Hukum Universitas Brawijaya Email:dewanata_rizky@yahoo.co.id  ABSTRAK Penelitian ini menganalisi penerapan Pasal 55 Peraturan Daerah Kota Batu Nomor 1 Tahun 2013 Tentang Penyelenggaraan Pariwisata. Di dalam Pasal tersebut mengatur tentang Penyelenggaraan kegiatan usaha pariwisata wajib memiliki izin usaha dan nomor induk yang diberikan oleh Walikota, atau pejabat yang ditunjuk. Namun pada kenyataan di lapangan ditemukan fakta bahwa terdapat banyak wisata petik apel yang tidak berizin atau dapat dikatakan ilegal. Hal ini tentunya dapat mengakibatkan penyerapan pendapatan asli daerah menjadi tidak optimal. Melalui penggunaan metode penelitian yuridis empiris diperoleh kesimpulan bahwa Penegakan hukum terhadap kegiatan usaha wisata petik apel tidak berizin dalam rangka penerapan Pasal 55 Peraturan Daerah Kota Batu Nomor 1 tahun 2013 Tentang Penyelenggaraan Pariwisata dipengaruhi oleh berbagai faktor antara lain yaitu Faktor Hukumnya, Faktor Penegak hukum, Faktor Sarana atau Fasilitas yang mendukung, Faktor Masyarakat dan Faktor Kebudayaan. Dalam hal ini faktor yang paling berpengaruh adalah faktor penegak hukumnya dan faktor masyarakat. Hal ini dapat terjadi demikian dikarenakan Pemerintah Kota Batu berorientasi pada kesejahteraan rakyat dan efisiensi kinerja birokrasi sehingga terkesan abai dalam menerapkan ketentuan terkait aspek perizinan pada wisata petik apel yang ada di Kota Batu. Kata Kunci: Penerapan Peraturan Daerah, Efektivitas Hukum, Perizinan, Wisata Petik Apel, Kota Batu. ABSTRACT This study analyzes the application of Article 55 of Batu City Regional Regulation No. 1 of 2013 on Tourism Implementation. In that Article regulates the Implementation of tourism business activities shall have a business license and a master number provided by the Mayor, or a designated official. But in reality in the field found the fact that there are many tours of apple apple that is not licensed or can be said illegal. This can certainly result in the absorption of local revenue to be not optimal. Through the use of empirical juridical research method, it is concluded that Law enforcement on apple tour business activities is not licensed in the framework of the implementation of Article 55 of Batu City Regional Regulation No. 1 of 2013 on Tourism Implementation is influenced by various factors such as Legal Factors, Factors Law Enforcement, Supporting Facilities or Facilities, Community Factors and Cultural Factors. In this case, the most influential factors are its law enforcement factors and community factors. This can happen as the Batu City Government is oriented towards the people's welfare and the efficiency of bureaucracy performance so as to be impressed in applying the provisions related to the licensing aspect of the apple tour in Batu City.
