Abstract

Syanindita Nirna Ingtias, Dr. Abdul Madjid, SH.MHum., Lutfi Effendi, SH.MHum. 145010101111025 Fakultas Hukum Universitas Brawijaya Email: Syaninditan.ingt@gmail.com   Abstrak Penelitian ini dilatar belakangi oleh permasalahan yang sering terjadi terhadap guru. Sudah seharusnya guru melaksanakan tugas profesionalnya yaitu mendidik peserta didiknya termasuk memberikan sanksi apabila peserta didiknya melanggar norma yang ada. Namun dalam memberikan sanksi yang bertujuan untuk mendisiplinkan peserta didiknya guru justru tersandung masalah hukum. Tidak jarang juga guru sering mendapat tindak kekerasan, ancaman, perlakuan diskriminatif, dan perlakuan tidak adil dari peserta didik, orangtua peserta didik, masyarakat, dan pihak lainnya. Kebijakan pemerintah telah menetapkan Peraturan Pemerintah Nomor 19 Tahun 2017 Tentang Perubahan Atas Peraturan Pemerintah Nomor 74 Tahun 2008 Tentang Guru memberikan kewenangan kepada pemerintah dan pemerintah daerah untuk memberi perlindungan hukum terhadap guru dalam melaksanakan tugasnya. Perlindungan hukum bagi guru merupakan bagian integral dari upaya untuk memenuhi hak-hak guru. Namun sehubungan dengan adanya Undang-Undang Nomor 35 Tahun 2014 Tentang Perubahan Atas Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak yang mengatur hak-hak dan perlindungan terhadap anak, termasuk juga peserta didik di sekolah, perlu adanya upaya sinkronisasi dan integrasi agar Undang-Undang tersebut menjadi konsisten dengan Peraturan Pemerintah tentang Guru. Kata Kunci: Perlindungan Hukum, Profesi Guru, Hak-hak Guru, Hak Anak dan Peserta Didik. Abstract This research is based on what teachers have commonly experienced. It is commonly accepted that teachers professionally work to educate their pupils and impose a sanction to those breaking the rules. Sometimes, the sanction imposed by the teacher will just drag teachers to court, and it is not rare to see some teachers threatened, hit, discriminated, and treated unjustly by pupils, pupils’ parents, societies, and other parties. With its policy, the government has stipulated the Government Regulation Number 19 of 2017 on Amendment to Government Regulation Number 74 of 2008 on Teachers, in which government and regional government are authorized to provide legal protection for teachers performing their professional work. Legal protection for the teachers is an integral part of efforts to meet teachers’ rights. Regarding the existence of the Amendment to Law Number 23 of 2002 on Child Protection which regulates rights of and protection for children, including pupils at schools, synchronization, and integration of law and Government Regulation on Teachers is required for better consistency. Abstract

Deforestation conditions in Indonesia reached a level of concern. Forests are often burned to open land for the construction of factories or gardens so that there is a transfer of functions that reduce land productivity and reduce the number of forests continuously. These conditions if continuously occur will certainly threaten the sustainability of forests as the heart of nature and cause negative impacts such as floods and landslides. The law prohibits illegal forest burning activities but is ruled out to local communities such as indigenous peoples who burn forests for collective interests rather than profit. The exclusion of vulnerable norms is exploited by irresponsible individuals. Through the provision of the ability to burn forests by local communities, corporations abuse the provision to open land for business activities. On the other hand, the Forestry Police as the institution responsible for forest sustainability does not have the capability to crack down because there is no special authority for the Forestry Police to map and analyze whether a forest fire that occurs is a natural event, done purely by local communities, or is a deliberate burning by corporations by utilizing local communities. Juridical issues in essence become upstream problems related to the criminal act of burning the veiled forest. So in this paper, the author tries to analyze the position and authority of the Forestry Police in cracking down on forest burning criminal acts covertly and recommends the expansion of the main duties and functions of the Forestry Police as a forest rescue strategy for the sustainability of Indonesia's environment for the foreseeable future.
