<![CDATA[Patricia IsabellaFakultas Hukum Universitas Brawijaya Abstrak Penelitian terpusat pada masalah legalitas Stasiun Pengisian Bahan Bakar Umum (SPBU) yang berdiri di atas Ruang Terbuka Hijau (RTH). Untuk memperoleh data, dilakukan penelitian dari perUndang-Undangan yang ada terkhusus Undang-Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang, Undang-Undang lain yang berkaitan, buku-buku, pendapat-pendapat para ahli dan artikel-artikel baik di media cetak ataupun media online. Berdirinya SPBU di RTH dapat terjadi karena memperoleh izin dari pemerintah yang berwenang, karena tingginya kebutuhan masyarakat akan Bahan Bakar Minyak (BBM). Tetapi berdasarkan ketentuan yang sudah ada RTH harus difungsikan sesuai fungsi utamanya. Belum ada ketentuan yang menyatakan bahwa RTH bisa digunakan menjadi badan usaha walaupun untuk kepentingan publik. Maka apabila SPBU berdiri di RTH maka ketentuan hukum menjadi kabur. Oleh karena itu, Pemerintah harus membentuk aturan baru yang mengaturmengenai status hukum izin berdirinya SPBU di RTH dan melindungi kelestarian RTH. Kata kunci: StasiunPengisianBahanBakarUmum, legalitas, Ruang Terbuka Hijau Abstract This research is focused on the issue over the legality required in the development of service station sited on a green open space (further stated as RTH). The data was obtained by observing the existing laws, especially Law Number 26 of 2007 on Spatial Planning, other related laws, books, experts’ views, and other related articles from online and printed media. The service station developed on RTH was supported by the license issued by an authorized government, as the need for fuels is growing. However, according to the existing regulation, RTH should function as it is regulated. There has not been any provision suggesting that RTH can be utilized for business purpose despite the public interests. The fact that the service station is sited on the RTH creates the ambiguity of law. Therefore, it is essential for the government to formulate a new regulation dealing with the legal status of the license required for the development of service station in RTH and protecting the sustainability of RTH.
