<![CDATA[Hary Saputra Hadi, Lutfi Effendi, SH., M.Hum, Agus Yulianto SH., MH Fakultas Hukum, Universitas Brawijaya harysaputrahadi@gmail.com  ABSTRAK Penelitian ini bertujuan untuk mengetahui efektivitas dalam penerapan efektif Pelaksanaan Pasal 38 Ayat (2) Peraturan Menteri Pertanian Republik Indonesia Nomor 114/Permetan/Pd.410/9/2014 Tentang Pengawasan Pemotongan Hewan Qurban, Adapun yang menjadi latar belakang penelitian ini adalah karena masih adanya terdapat hasil penelitian dilapangan masih banyak hewan qurban yang tidak dilakukan pengawasan sesuai aturan tersebut, misalnya tidak ada lebel terhadap hewan qurban yang diperiksa oleh Dinas pertanian, dikarenakan dari pihak Dinas pertanian khususnya di bagian peternakan masih sangat kekurangan Dokter hewan untuk bagian pemeriksaan hewan qurban. Pendekatan penelitian menggunakan pendekatan yuridis sosiologis. Jenis dan sumber data penelitian adalah data primer dan data sekunder. Teknik pengumpulan data berupa teknik wawancara kepada pihak-pihak yang terkait dan studi kepustakaan. Hasil penelitian menunjukkan bahwa dalam efektif Pelaksanaan Pasal 38 Ayat (2) Peraturan Menteri Pertanian Republik Indonesia Nomor 114/Permetan/Pd.410/9/2014 Tentang Pengawasan Pemotongan Hewan Qurban, belum berjalan efektif karena masih ditemukannya hambatan yang masih belum terselesaikan dan belum memenuhi factor pendukung efektivitas suatu peraturan. The research approach uses sociological juridical approach. The types and sources of research data are primary and secondary data. Data collection techniques are interview techniques to related parties and literature study. The results of the research indicate that in the effective implementation of Article 38 Paragraph (2) of Regulation of the Minister of Agriculture of the Republic of Indonesia No. 114 / Permetan / Pd.410 / 9/2014 on the Observation of the Cutting of Animal Sacrifice, has not been effective since there are still unresolved obstacles factors supporting the effectiveness of a rule.
