<![CDATA[Ade Chandra Nurlaksono, Dr. Herman Suryokumoro, S.H.,MS, Lutfi Effendi S.H., M.Hum Fakultas Hukum Universitas Brawijaya Email: Chadraade@gmail.com  Abstrak Desa merupakan suatu kesatuan masyarakat yang memiliki hak untuk mengurus dirinya sendiri berdasarkan adat dan budaya setempat, hal ini yang dinamakan otonomi desa. Bentuk perwujudan dari otonomi desa, dalam pasal 87 Undang-Undang Nomor 6 tahun 2014 dijelaskan bahwa desa dapat membentuk suatu Badan Usaha Milik Desa (BUM Desa). Permasalahan terkait BUM Desa dapat terjadi dikarenakan dalam Pasal 12 Peraturan Menteri Dalam Negeri Nomor 28 Tahun 2006 serta Pasal 11 Ayat (2) Undang-Undang Nomor 6 Tahun 2014 Tentang Desa secara umum menjelaskan bahwa jika terjadi perubahan status desa menjadi kelurahan maka aset desa akan berpindah ke Pemerintah Daerah dan sumber kekayaan desa akan dikelola kelurahan. Dalam peraturan tersebut belum jelas tata cara perubahan status hukum BUM desa sedangkan desa dan kelurahan memiliki perbedaan dalam mengatur wilayahnya sehingga akan membuat ketidakpastian hukum terhadap BUM Desa. Kata kunci: Implikasi yuridis, Status Hukum , Desa Abstract A village is a unit of community that has authority to manage its own affairs according to its customs and culture, which is called the autonomous village. The form of autonomous village in Article 87 of the Law Number 6 Year 2014 is explained that the village can form a village-owned enterprises (hereinafter referred to as BUM Village). The problem related to the BUM Village arose because in Article 12 of the Decision of Minister of Home Affairs Number 28 Year 2006 and Article 11 paragraph (2) of the Law Number 6 Year 2014 on Village generally explain that if the status of village changes into the administrative village, then village assets will be transferred into local government and the wealth of the village will be managed by the administrative village. In these law and regulation, it is still not clear about procedures of the changing legal status of BUM Village, meanwhile, village and administrative village have differences on managing its jurisdiction, so it causes legal uncertainty towards BUM Village.
