<![CDATA[Beryl Yerikho Agusta, Amelia Sri Kusuma Dewi, S.H., MKn, Dr. Reka Dewantara, S.H., M.H Fakultas Hukum, Universitas Brawijaya Email: berylyerikho@ymail.com  ABSTRAK Skripsi ini di latar belakangi oleh permasalahan perlindungan terhadap anggota koperasi dalam hal koperasi melakukan kegiatan penghimpunan dana tanpa izin. Dalam penelitian juga membahas bagaimana bentuk perlindungan hukum terhadap anggota koperasi dalam bentuk preventif maupun represif. Tujuan penelitian ini adalah untuk menganalisisa bentuk perlindungan hukum yang dapat diberikan kepada para korban atau anggota koperasi yang mengalami kerugian akibat koperasi melakukan kegiatan penghimpunan dana tanpa izin. Bentuk perlindungan hukum preventif terdapat di dalam Undang-Undang Nomor 25 Tahun 1992 Tentang Perkoperasian, Peraturan Menteri Nomor 17/Per/M.KUKM/IX/2015 Tentang Pengawasan Koperasi. Bentuk perlindungan hukum represif bagi anggota koperasi yaitu dengan adanya sanksi berupa penggantian kerugian yang diatur didalam Undang-Undang Nomor 25 Tahun 1992 Tentang Perkoperasian, dan sanksi administratif dan pidana penjara agar mendapat efek jera dan mengakhiri kegiatan koperasi yang membuat kerugian bagi anggota koperasi yang diatur didalam Undang-Undang No. 7 Tahun 1992 Tentang Perbankan. In the study also discussed how the form of legal protection for members of cooperatives in the form of preventive and repressive. The purpose of this study was to analyze the form of legal protection that could be given to victims or members of cooperatives who suffered losses due to cooperatives carrying out fundraising activities without permission. The form of preventive legal protection is contained in Law Number 25 of 1992 concerning Cooperatives, Ministerial Regulation Number 17 / Per / M.KUKM / IX / 2015 concerning Cooperative Supervision. Repressive form of legal protection for members of cooperatives is the existence of sanctions in the form of compensation which is regulated in Law Number 25 of 1992 concerning Cooperatives, and administrative sanctions and imprisonment in order to get a deterrent effect and end the activities of cooperatives which make losses to cooperative members regulated in Law No. 7 of 1992 concerning Banking.
