Fakultas Hukum Universitas Brawijaya Email : saviramrp@gmail.com  ABSTRAK Kebijakan Zero Tolerance Immigration dikeluarkan sebagai upaya Amerika Serikat (AS) untuk menekan jumlah kedatangan imigran ilegal yang kian bertambah setiap tahunnya. Melalui kebijakan ini, pemerintah AS tanpa adanya toleransi menangkap dan menahan para pelaku yang secara ilegal menyebrangi perbatasan negara di wilayah Barat Daya AS, termasuk terhadap pencari suaka yang terpaksa meninggalkan wilayahnnya untuk mencari perlindungan dan suaka di AS. Sebagai negara peserta Protokol 1967 terkait Status Pengungsi, AS mempunyai kewajiban untuk melindungi dan memberikan hak-hak terhadap Pencari Suaka, meskipun kedatangannya dianggap melanggar hukum. Namun disisi lain, sebagai bentuk tindakan sementara, AS juga diberi hak untuk menolak kedatangan pencari suaka jika keamanan nasionalnya terancam. Jurnal ini kemudian menganalisis perbandingan prosedur serta dasar pertimbangan dikeluarkannya kebijakan Zero Tolerance Immigration dengan ketentuan yang ada dalam Protokol Pengungsi 1967, dengan tujuan untuk mengetahui keabsahan Kebijakan Zero Tolerance Immigration yang dikeluarkan AS menurut Protokol Pengungsi 1967 serta implikasi yuridis yang ditimbulkan terhadap pencari suaka yang ditangkap karena berlakunya kebijakan ini . Jurnal ini merupakan penelitian normatif, dengan menggunakan pendekatan perundang-undangan, pendekatan konseptual, serta pendekatan historis. Kata Kunci: Kebijakan Zero Tolerance Immigration, Pencari Suaka, Protokol Pengungsi 1967  ABSTRACT The policy concerning Zero Tolerance Immigration was issued as a measure for the US to reduce entering legal immigrants whose number keeps increasing every year. With this policy, the US government gives zero tolerance to those crossing states’ borders established in the southwest of the US, and breaking the rule could lead to arrest. This regulation also applies to asylum seekers who are forced to flee their countries for the US. As a member of the Protocol related to Status of Refugees, the US holds the responsibility to protect and give the rights to asylum seekers although their entry violates the law. On the other hand, in terms of temporary response, the US also holds the right to decline asylum seekers only when the national security is under threat. This research is aimed to analyse the comparison of the procedure and the basis of consideration over the implementation of Zero Tolerance Immigration according to the provisions in the 1967 Protocol related to refugees. This is performed to find out the validity of the policy made by the US according to the 1967 Protocol concerning Refugees and juridical implication arising from the arrested asylum seekers in regards to the implementation of the policy. The research was conducted based on normative method along with statute, conceptual, and historical approaches.
