Abstract

Ismi Pratiwi Podungge, Ratih Dheviana Puru HT, SH., LLM, Syahrul Sajidin, SH., M.H Fakulastas Hukum Universitas Brawijaya tiwipodungge@gmail.com  ABSTRAK Penelitian ini bertujuan untuk mengetahui kesesuaian pengaturan pemberian manfaat Jaminan Kecelakaan Kerja bagi Pekerja Migran Indonesia selama bekerja di negara penempatan berdasarkan Permenaker Nomor 18 Tahun 2018 tentang Jaminan Sosial Pekerja Migran Indonesia dengan Prinsip-prinsip Penyelenggaraan Jaminan Sosial yang diatur dalam Undang-Undang Nomor 40 Tahun 2004 tentang Sistem Jaminan Sosial Nasional. Penelitian ini merupakan penelitian yuridis normatif dengan metode pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum yang digunakan dalam penelitian ini adalah bahan hukum primer, sekunder, dan tersier. Teknik pengumpulan bahan hukum yang digunakan melalui studi kepustakaan dan melalui akses internet. Analisis bahan hukum yang digunakan oleh penulis adalah intrepertatif sistematis. Berdasarkan hasil penelitian ini, maka dapat disimpulkan bahwa pengaturan pemberian manfaat Jaminan Kecelakaan Kerja bagi Pekerja Migran Indonesia selama bekerja di negara penempatan sebagaimana di atur dalam Pasal 17 Peraturan Menteri Ketenagakerjaan Nomor 18 Tahun 2018 tentang Jaminan Sosial Pekerja Migran Indonesia memiliki kesesuaian dengan 5 (lima) prinsip dari 9 (sembilan) prinsip yang diatur dalam Pasal 4 Undang-Undang Sistem Jaminan Sosial Nasional Nomor 40 Tahun 2004, yaitu Prinsip Kegotongroyongan, Prinsip Nirlaba, Prinsip Kepesertaan Wajib, Prinsip Dana Amanat, dan Prinsip Hasil Pengelolaan Dana. Kata Kunci : PMI, Jaminan Kecelakaan Kerja, Prinsip Penyelenggaraan Jaminan Sosial   ABSTRACT This research is aimed to study the relevance of the regulation concerning benefits gained from Insurance for Work Accident for Indonesian migrant workers during placement overseas according to the Regulation of the Ministry of Labours Number 18 of 2018 concerning Social Security for Indonesian Migrant Workers along with Social Security Enforcement Principles as regulated in Act Number 40 of 2004 concerning National Social Security System. Normative juridical method was employed along with statue and conceptual approaches. The legal materials involved primary, secondary, and tertiary data, all of which were obtained from literature review and the Internet, followed by data analysis based on systematic interpretation. The result reveals that the benefits given by Insurance of Work Accident for Indonesian Migrant Workers during their placement overseas, as regulated in Article 17 of Regulation of the Ministry of Labours Number 18 of 2018, is relevant to five out of nine principles regulated in Article 4 of Act concerning National Social Security System Number 40 of 2004: mutual work, non-profit, compulsory participation, trust-based fund, and fund management principles. Abstract

This study aims to determine the role of trade unions in settling disputes over unilateral termination of employment by companies against employees. Termination of Employment Relations has a separate arrangement contained in Chapter XII Law No. 13 of 2003 concerning Employment. However, in practice in the field, this law still has several weaknesses, wherein the regulations there are loopholes that can make companies deviate from the content/meaning of the rules regarding Termination of Employment. In the era of the digitization of company equipment, employers terminated their employment on the pretext of company efficiency, which resulted in the removal of many employees' rights with the modernization of equipment. This has a big impact in the long run and further increases the unemployment rate in society. In addition to digitization, companies often use the pretext that termination of employment for company efficiency is permissible as long as it is in accordance with the provisions of laws and regulations. The type of research used by the author is a type of normative juridical research that focuses on the use of library data or secondary data in the form of primary, secondary, and tertiary legal materials. The data analysis used by the writer used the descriptive qualitative method, which is a description in the form of regular, coherent, logical, and effective sentences. Based on the results of this study, it can be seen that a trade union is very much needed in dealing with problems that exist in a company, one of which is the problem of termination of employment which is usually carried out unilaterally by the company and is detrimental to the employees himself. In this paper, the author also intends to compare the arrangement of the role of Trade Unions in termination of employment in Law No. 13 of 2003 Concerning Employment with Law No. 11 of 2020 concerning Job Excogitation.
