Abstract

Fakultas Hukum Universitas Brawijaya rizqibektu@gmail.com  ABSTRAK Penelitian ini mengkaji tinjauan yuridis pasal 7 Undang-undang No. 34 Tahun 2004 tentang Tentara Nasional Indonesia, dimana pasal tersebut menjelaskan tentang Operasi Militer Selain Perang, tetapi dalam pasal tersebut tidak dijelaskan tentang pengaturan kewenangan wilayah OMSP. OMSP memiliki beberapa kegiatan yang memang sudah diatur dalam perjanjian-perjanjian antar pihak yang menjelaskan tugas pokok dan kegiatan OMSP di luar yurisdiksi nasional, tetapi dalam hal mendesak aturan perundang-undangan negara Indonesia tidak mengatur secara detail mengenai kewenangan dari OMSP sendiri. Ketidakjelasan dari aturan tersebut menimbulkan pertanyaan bagaimana kewenangan dan penerapan OMSP di luar yurisiksi nasional bagi beberapa pihak. Adapun jenis penelitian yang digunakan penulis adalah jenis penelitian normatif. Menggunakan pendekatan perundang-undangan, yang mengacu pada norma-norma yang berlaku. Penelitian ini mengkaji masalah dengan cara meneliti dari segi ilmu hukum. Tujuan dari penelitian ini ialah untuk mengetahui kewenangan yang diatur oleh undang-undang No. 34 Tahun 2004 Tentang Tentara Nasional Indonesia tentang OMSP diluar yurisdiksi nasional, dimana untuk tindakan OMSP memerlukan persetujuan Panglima TNI dan Keputusan Presiden yang disetujui oleh DPR, terutama untuk OMSP yang melakukan kontak senjata dan berhubungan dengan organisasi lain. Penelitian ini bertujuan untuk mengetahui kewenangan TNI dala melakukan OMSP diluar yurisdiksi nasional karena tidak diatur dalam Undang-undang No, 34 Tahun 2004. Mengetahui kurangnya peraturan yang mengakomodir tentang kewenangan wilayah OMSP dalam hukum nasional, perlu dilakukannya tambahan untuk kajian kewenangan wilayah OMSP bagi TNI dalam hukum nasional. Kata kunci: OMSP diluar Yurisdiksi Nasional, Tentara Nasional Indonesia   ABSTRACT This research studies juridical review of Article 7 of Act Number 34 of 2004 concerning Indonesian Armed Forces, where the law explains military operations other than war but does not include details on authorities over territory where military operations other than war (hereinafter MOOTW) take place. The military operations deal with several activities regulated in agreements for parties, which is aimed to elaborate the main tasks and activities of MOOTW outside national jurisdiction. However, certain regulations in Indonesia still do not include any details on authorities of the MOOTW per se. This lack of clarity raises a question over authorities and implementation of MOOTW outside national jurisdiction for several parties. This is a normative research employing statute approach that refers to existing norms, in which it is based on legal studies. This research is basically aimed to find out the authorities regulated in Act Number 34 of 2004 concerning Indonesian Armed Forces regarding MOOTW outside national jurisdiction, in which all activities of MOOTW require the approval of Indonesian Armed Forces Commander and Presidential Decree approved by the House of Representatives (DPR), especially for MOOTW involving exchanging fire and related to other organisations. This research is also intended to seek into the authorities of Indonesian National Forces to conduct MOOTW outside national jurisdiction because it is not regulated in Act Number 34 of 2004. Since the authorities of MOOTW in the territory of national law are not well accommodated, it is important that the study on authorities of the MOTW within the national law territory for Indonesian Armed Forces be extended. Abstract

This research aims to address the growing problem of illegal sea fencing in Tangerang and Bekasi waters, which has significant negative impacts on marine ecosystems, biodiversity and the livelihoods of local fishing communities. This research explores the effectiveness of international legal frameworks, specifically the United Nations Convention on the Law of the Sea (UNCLOS), in regulating and enforcing maritime activities related to illegal sea fencing in Indonesia. The study will evaluate the role of national law enforcement agencies in addressing illegal practices such as unauthorised fishing, sand mining and smuggling, focusing on jurisdictional challenges and enforcement mechanisms. The benefits of this research are enhancing marine conservation efforts, improving law enforcement practices, supporting coastal communities by protecting their livelihoods, promoting international cooperation in maritime law enforcement, and increasing public awareness of legal compliance to ensure more sustainable use of marine resources. This article emphasises the need for stronger enforcement mechanisms, clearer regulations and better coordination among stakeholders. A more integrated approach, involving local communities alongside the government, is essential to effectively tackle illegal marine fencing and protect the environment and livelihoods of local people. The study also revealed that current legislation does not fully address the complexity of the issue, such as the wider environmental impacts of sea fences and the economic impact on the region.
