Abstract

Agung Tri Wicaksono, Ratih Dheviana Puru Hitaningtyas, SH., LL.M , Syahrul Sajidin, SH., MH.Fakultas Hukum Universitas BrawijayaEmail : awicaksono28@gmail.com ABSTRAKKetentuan mengenai pengaturan waktu kerja sudah diatur di dalam Pasal 77 Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan. Masih pada Pasal 77 ayat (3) dan (4), pengaturan waktu kerja tersebut tidak berlaku bagi sektor usaha atau pekerjaan tertentu. Untuk pengaturan mengenai waktu kerja bagi sektor usaha atau pekerjaan tertentu harus diatur tersendiri oleh Peraturan Menteri Tenaga Kerja dan Transmigrasi dan Keputusan Menteri Tenaga Kerja dan Transmigrasi. Jenis-jenis pekerjaan yang digolongkan ke dalam sektor usaha atau pekerjaan tertentu disebutkan di dalam penjelasan Pasal 77. Sampai saat ini tidak ada pengaturan yang mengatur mengenai waktu kerja dan waktu istirahat, padahal pekerja di sektor transportasi atau sopir angkutan jarak jauh yang termasuk ke dalam salah satu sektor usaha atau pekerjaan tertentu. Pengaturan mengenai waktu kerja dan istirahat bagi pekerja di sektor transportasi harus diatur, karena apabila tidak diatur mengenai waktu kerja dan waktu istirahat, maka tidak ada kejelasan batas waktu kerja dan istirahat bagi pekerja di sektor transportasi. Berdasarkan hal tersebut, dalam skripsi ini penulis mengkaji seluruh peraturan mengenai waktu kerja yang ada di Indonesia serta pengaturan waktu kerja bagi pekerja di sektor transportasi yang ada di dalam Konvensi ILO No.153 untuk kemudian membuat konsep peraturan mengenai waktu kerja dan waktu istirahat bagi pekerja di sektor transportasi yang bertugas dalam pendistribusian barang. Kata Kunci: waktu kerja, waktu istirahat, pekerja di sektor transportasi  ABSTRACTProvision of rule regarding working and break time is regulated in Article 77 of Law Number 13 of 2003 concerning Labour Affairs. Article 77 Paragraph (3) and (4) states that this regulation is not relevant to several business and working sectors, and the provisions regarding working time in particular sectors must be independently regulated in Regulation of Minister of Labour Affairs and Transmigration and the Decree of Minister of Labour Affairs and Transmigration. Particular types of work belonging to certain sectors are classified in Article 77. To date, there have not been regulations governing working time and break time, while transport-related work such as long-distance route drivers is categorised as a particular type of job. Jobs in transportation sector have to be governed in terms of working time and break time. In reference to this issue, the author intends to study all the regulations concerning working time in Indonesia and the working time for those who work in transport industry within the Convention of ILO No. 153. This should be followed by the making of a new concept of regulation governing working time and break time for people working in transportation especially those working in distribution department. Abstract

The International Criminal Court (ICC) or International Criminal Court is a court that is not under the United Nations (UN) and is independent and has jurisdiction to try a person/country suspected of committing serious human rights crimes such as war crimes, genocide and crimes. towards humans. However, in reality, the ICC seems to ignore acts of genocide and war crimes committed by Israel against Palestine on the pretext that Israel does not recognize the Rome Statute and is not a member of the ICC, so Israel cannot be subject to any sanctions from the ICC. The aim of this research is to examine and explore why the ICC seems to be ignoring Israel's actions, which should be under its jurisdiction. The method used in this research is juridical/normative legal research with the Roman Statute as the primary legal material. The findings of this research are that Israel should still be subject to sanctions by the ICC based on article 12 paragraph 2 of the Rome Statute which states that the ICC's jurisdiction also applies to non-ICC countries that commit crimes in the territory of countries that recognize the Rome Statute, in this case Palestine has ratified the Statute. Rome on April 1 2015. The implication of this research is that Israel can be tried by the ICC even though they have not ratified the Rome Statute.
