Abstract

Pelaku usaha menjual produk kosmetik share in jar atau kosmetik yang dibagi kedalam wadah kecil untuk dijual kembali dengan harga yang lebih murah, dan tidak dilengkapi dengan informasi ini bertentangan dengan Pasal 4 Huruf A dan C Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen yang menyebutkan bahwa setiap konsumen memiliki hak untuk mendapatkan informasi terkait produk dan konsumen berhak merasa aman, nyaman dan selamat saat memakai produk. Adapun jenis penelitian yang digunakan penulis adalah jenis penelitian yuridis empiris dengan pendekatan yuridis sosiologis yang dilakukan dengan cara penelitian langsung untuk memperoleh data. Metode pengambilan data dilakukan dengan cara studi dilapangan dengan melakukan wawancara kepada Balai Besar Pengawas Obat dan Makanan di Surabaya, pelaku usaha serta memberikan kuisioner kepada konsumen. Analisis data yang digunakan oleh penulis menggunakan metode deskriptif kuantitatif. Berdasarkan hasil penelitian ini maka dapat diketahui bahwa penerapan Pasal 4 Huruf A dan C Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen terkait hak konsumen terhadap peredaran kosmetik share in jar belum maksimal dikarenakan beberapa faktor, yakni dari faktor penegak hukum, peraturan perundang-undangan yang mengatur, kesadaran konsumen serta pelaku usaha. Kata Kunci: Penerapan pasal, Hak-hak Konsumen, Kosmetik Share in Jar   Abstract Violation of consumer rights is common to find. For example, cosmetics packed in small jars sold at a low price without useful information of the product violate Article 4 letter A and C of Law Number 8 of 1999 concerning Consumer Protection, stating that every consumer has his/her right to obtain information on products and every consumer has a right to feel secured of the products he/she uses. This research was conducted based on empirical juridical method with socio-juridical approach, involving direct observation to obtain data. Interviews with the persons in charge of the hall of the agency in Surabaya and business owners were performed. Moreover, questionnaires were also distributed to consumers. The research result reveals that the law mentioned earlier has not been effectively implemented regarding the distribution of share-in-jar cosmetics due to several factors coming from law enforcers, legislation, and the awareness of consumers and businessmen. Abstract

To embody the ease of doing business, the government introduced a new entity, namely a single-member company, by adhering to a one-tier system but not in line with the organs regulated in Law Number 40 of 2007 concerning Limited Liability Companies. The objective of the research is to examine the one-tier system in single-member companies in Indonesia. This research is normative-descriptive juridical research through literature study and aims to analyze the juridical implications of the one-tier system in the organs of single-member companies after the enactment of Law Number 11 of 2020 concerning Job Creation. Based on the results of the study, it is known that there are differences in the terms used in the designation of single-member company organs, and there may be concurrent positions in single-member companies, this has implications for the absence of the checks and balances principle in a company and concurrent positions in a company have the potential to cause a conflict of interest where every management action that contains a conflict of interest is categorized as an act of bad faith. Because such actions are considered as a breach of fiduciary duty and the obligation to obey the laws and regulations.
