Abstract

Haryono No. 169 Malang Email: qoirulbastomi13@gmail.com   Abstrak Penelitian ini bertujuan untuk menganalisa dan mendeskirpsikan makna azas nebis in idem sebagai dasar pertimbangan hakim dalam menetapkan sah atau tidaknya tersangka. Dalam Pasal 76 ayat (1) dan (2) KUHP, mengatur tentang Hapusnya Kewenangan Menuntut Pidana dan Menjalankan Pidana, yaitu salah satunya azas nebis in idem. Akan tetapi, Azas nebis in idem yang secara konseptual diberlakukan pada saat proses pemeriksaan acara biasa di pengadilan, namun kemudian dimasukkan dalam pertimbangan putusan praperadilan yang pada dasarnya hanya berwenang memeriksa sebelum proses pemeriksaan perkara di sidang pengadilan, tidak termasuk pada pengaduan ataupun praperadilan. Adapun jenis penelitian yang digunakan penulis adalah metode penelitian hukum yuridis normative yang berfokus pada inventarisasi hukum positif, asas-asas, dan doktrin hukum, dan penemuan hukum dalam perkara in concreto. Metode Pendekatan yang dipilih oleh penulis adalah dengan menggunakan Pendekatan Peraturan Perundang-Undangan dan Pendekatan Kasus. Analisis bahan hukum yang digunakan penulis adalah menggunakan Penafsiran Sistematis dan Penafsiran Gramatikal, yaitu penafsiran yang menghubungkan pasal yang satu dengan pasal-pasal yang lain dalam suatu perundang-undangan yang bersangkutan atau pada perundang-undangan hukum lainnya, serta memberikan arti kepada suatu istilah atau perkataan sesuai dengan tata bahasa. Berdasarkan hasil penelitian maka dapat diketahui bahwa penggunaan azas ne bis in idem dalam pertimbangan hakim Putusan Praperadilan Nomor 19/PRA.PER/2016/PN.SBY tidak sesuai dengan Hukum Acara Pidana. Kata Kunci: Praperadilan, nebis in idem, dasar pertimbangan hakim, penetapan tersangka   ABSTRACT This research is aimed to analyse and describe the term of the principle nebis in idem as the basic consideration taken by the judge in determining the validity of a status as a suspect. Article 76 Paragraph (1) and (2) of Criminal Code regulates abolished authority to file a charge or to serve a sentence according to the principle of nebis in idem. However, this principle is conceptually referred to for investigation of ordinary case at court, which is further included in the consideration of the decision during pre-trial. Pre-trial stage only involves authority of inspection before the investigation process at court, not involves any report to the police or pre-trial. This research was conducted based on normative-juridical method focused on inventory of positive law, principles, legal doctrines, and legal findings in an in concreto case, supported by statute and case approaches. The data obtained was further analysed based on systematic and grammatical interpretation, both of which involved connecting articles in relevant laws or in other laws. Definition was given to terms by following grammatical rules. The research result finds out that the use of nebis in idem principle in the consideration taken by the judge in the Decision Number 19/PRA.PER/2016/PN.SBY is not in line with Criminal Code Procedure. Abstract

This study aims to analyze the effectiveness of the penal mediation approach in resolving illegal mining crimes (PETI) in the jurisdiction of the East Java Regional Police, which has been dominated by a repressive approach and has caused complex social, economic, and ecological problems. The repressive approach has failed to address the root causes of the problem, and PETI is often carried out by economically vulnerable groups due to an inclusive bureaucracy. The research method employed is a sociological-legal approach, combining normative analysis of legal regulations (das sollen) with empirical studies of law enforcement practices in the field (das sein). The research findings indicate that criminal mediation has gained legal legitimacy through various regulations, including the 2023 National Criminal Code, Police Regulation No. 8 of 2021, and Regulation No. 15 of 2020. In East Java, 393 PETI cases were resolved using this approach during 2023–2024, preventing 1,650 offenders from conventional litigation and saving law enforcement budgets. This approach reflects the renewal of Indonesian criminal law, which not only punishes but also restores and empowers. This study provides empirical evidence on the application of panel mediation in environmental criminal cases, an area rarely explored in previous research.
