Abstract

Haryono No. 169 Malang Email : Dwilestariindahs56@gmail.com   ABSTRAK Penelitian ini bertujuan untuk mengetahui dan menganalisis mengenai orisinalitas karya cipta yang dihasilkan oleh kecerdasan buatan (artificial intelligence) ditinjau dari undang-undang nomor 28 tahun 2014 tentang hak cipta. Adapun jenis penelitian yang digunakan penulis adalah jenis penelitian Normatif. Teknik pengumpulan data berupa studi kepustakaan atau library research. Teknik analisis data menggunakan metode deduksi. Berdasarkan hasil penelitian dapat diketahui bahwa karya cipta yang dihasilkan oleh kecerdasan buatan atau artificial intelligence merupakan karya cipta yang dapat mendapat perlindungan hak cipta karena termasuk karya yang orisinal ditinjau dari labor theory, reward theory dan idea-expression dichotomy sepanjang termasuk objek ciptaan yang dilindungi dan termasuk dalam bidang art work, literary work, dan science.   Kata Kunci : Orisinalitas, Karya Cipta, Kecerdasan Buatan, Artificial Intelligence.

Abstract

Provisions regarding the export of sea sand have long been banned and have now been legalized again with the promulgation of Government Regulation Number 26 of 2023 concerning Management of Sedimentation Products in the Sea which has raised various resistances from activists and environmental movements. an act will affect the legal system in society. According to Lawrence M Friedman, the legal system consists of three important components, namely substance which relates to the content of a legal product, legal structure which relates to the producer of legal products and legal culture which relates to the attitudes and expectations of society towards law. In this study, we will discuss how Government Regulation Number 26 of 2023 is from the perspective of the legal system according to Lawrence M Friedman.

Abstract

Medical tourism is a global phenomenon in which individuals travel across countries to receive medical or health care. Although not directly recognized as a major component of human rights (HAM), medical tourism has a relevant impact on human rights aspects in countries like Indonesia. The Indonesian government has an important role in regulating medical tourism by taking into account the human rights framework. This involves developing regulations that ensure the protection of patient rights, monitoring quality medical practice, and fulfilling access to health services for all citizens, both local and medical tourists. This article provides a brief analysis of how medical tourism can impact several aspects of human rights including the right to health. However, this approach also raises questions about equitable access to medical care for local populations. In order to maintain a balance between benefits and negative impacts, implementing medical tourism in accordance with human rights principles will support the sustainable goal of providing quality and equitable medical care for all individuals, without violating human rights.
