Abstract

Haryono No. 169 Malang e-mail: annisaaprilia@student.ub.ac.id   ABSTRAK Penelitian ini bertujuan untuk mengidentifikasi hambatan-hambatan pelaksanaan pemberian manfaat Jaminan Kecelakaan Kerja (JKK) pada sektor usaha pertambangan pada BPJS Ketenagakerjaan Kabupaten Mimika; serta mendeskripsikan, dan menganalisis upaya-upaya untuk mengatasi hambatan-hambatan tersebut. Jenis penelitian yang digunakan adalah jenis yuridis empiris dengan menggunakan metode pendekatan yuridis sosiologis. Berdasarkan hasil penelitian, diketahui bahwa pelaksanaan kewajiban BPJS Ketenagakerjaan Kabupaten Mimika dalam pemberian manfaat JKK pada sektor usaha pertambangan mengalami hambatan berdasarkan teori efektifitas ditinjau dari struktur hukum, substansi hukum, dan kultur hukum. Upaya-upaya untuk mengatasi hambatan-hambatan tersebut yaitu melakukan pengecekan dan penelusuran dari data pekerja sebagai upaya mengatasi hambatan masih banyak pekerja yang tidak memiliki dokumen kependudukan, menindaklanjuti penggantian biaya kepada fasilitas pelayanan kesehatan dan membangun kontrak kerja dengan fasilitas pelayanan kesehatan sebagai upaya mengatasi hambatan penggantian biaya oleh BPJS Ketenagakerjaan yang tidak ditanggapi oleh fasilitas pelayanan kesehatan perusahaan tambang, dan melakukan pemanggilan dan sosialisasi kepada perusahaan tambang terkait kewajiban pelaporan kecelakaan sebagai upaya mengatasi hambatan perusahaan tambang yang dalam masa tertentu tidak melapor kecelakaan kepada instansi terkait ketenagakerjaan. Kata Kunci: BPJS Ketenagakerjaan, Manfaat JKK, Pertambangan ABSTRACT This research is aimed to identify hindrances in the provision of benefits of Insurance for Work Accident (hereinafter JKK) in mining business sector Social Security Program for Workers in the Regency of Mimika, to describe and analyse the measures taken to tackle the impeding factors. Empirical juridical method and socio-juridical approach were employed. The research reveals that the provision encounters issues according to the theory of effectiveness, legal structure, legal substance, and legal culture. Some measures are taken to tackle the issues such as checking and investigating the data of the workers, and this investigation has found out that several workers do not have their identity of citizenship. What has to be taken as measures involves the reimbursement of cost spent for healthcare facilities, establishment of work contract between the company and healthcare services provider as part of compensation for healthcare services not recognised and accepted in mining companies, summoning and giving information to the mining company over report of accident at work, especially for the incident not reported within a certain period of time to a related institution. Abstract

Disputes are a reality that cannot be separated from human life, not least in the Collective Labor Agreement (PKB) negotiation forum. The existence of negotiations is one of the determining processes in the decline, stagnation, or increase in workers' rights, of course, followed by the rights and obligations of each in a balanced manner. The results of this study indicate that the disputes that occurred in the PT Freeport Indonesia Collective Labor Agreement negotiations were a form of realistic disputes in the form of interests with the demands, benefits, strengths, resources, and values to be achieved by both parties through the proposals of the parties. which is fought for acceptance becomes a provision in the collective labor agreement. The workers are trying to improve the fulfillment of workers' rights, while the employers are of the opinion that the obligations and rights of each party have been fulfilled in a balanced way. However, the absence of restrictions on collective bargaining agreements will have implications for the period of implementation of the fulfillment of the rights of workers stipulated in the new collective labor agreement and will have an impact on the collective work agreement of the company or contractor who is a joint partner of PT Freeport Indonesia.
