Harono No. 169 Malange-mail: faisalsuhandi13@gmail.comABSTRAKTujuan penelitian ini ialah mengetahui dan menganalisis faktor-faktor yang menyebabkantidak efektifnya Pasal 2 ayat (1) Peraturan Menteri Perhubungan Nomor PM 82 Tahun 2014Tentang Tata Cara Penerbitan Surat Persetujuan Berlayar tidak efektif di Kantor UnitPenyelenggara Pelabuhan Kelas II Branta Kabupaten Pamekasan. Serta mengetahui danmenganalisis penegakan hukum terhadap kapal yang tidak memiliki surat persetujuanberlayar di Kantor Unit Penyelenggara Pelabuhan Kelas II Branta Kabupaten Pamekasan.Adapun metode penelitian yang penulis gunakan ialah penelitian yuridis empiris. Denganpendekatan yuridis sosiologis, melalui pendekatan ini penulis mendapatkan informasi bahwadi Kabupaten Pamekasan penerapan Pasal 2 ayat (1) Peraturan Menteri PerhubunganNomor PM 82 Tahun 2014 tentang Tata Cara Penerbitan Surat Persetujuan Berlayar belumsepenuhnya efektif, hal ini dipengaruhi oleh beberapa faktor diantaranya ialah masyarakatmasih banyak yang awam dan minimnya pengetahuan hukum serta kesadaran hukum yangmasih tergolong rendah.Kata Kunci: Efektivitas, Hukum, Surat Persetujuan Berlayar. Abstract The aim of this study is to understand and analyze the factors that cause the ineffectiveness of Article 2 paragraph (1) of Regulation of the Minister of Transportation Number PM 82 Year 2014 concerning Procedures for the Issuance of Sailing Approval Letter at the Port Organizer Unit Office Class II Branta Pamekasan Regency. Furthermore, it also aims to understand and analyze the law enforcement against ships that do not have a sailing approval letter at the Port Organizer Unit Office Class II Branta Pamekasan Regency. The research method used empirical legal research with a sociological juridical approach. Through this approach the author obtained information that in Pamekasan Regency, the implementation of Article 2 paragraph (1) of Regulation of the Minister ofTransportation Number PM 82 Year 2014 concerning Procedures for the Issuance of SailingApproval Letter was ineffective.
