Abstract

Haryono No.169 Malang e-mail: riccaanindya@gmail.com  ABSTRAK Penelitian ini bertujuan untuk menganalisis dasar pertimbangan hakim dalam mengabulkan permohonan izin poligami dengan surat pernyataan menanggung resiko oleh calon istri kedua selaku pegawai negeri sipil dengan aturan pada Pasal 4 ayat (2) PP Nomor 45 Tahun 1990. Jenis penelitian yang digunakan penulis yaitu Yuridis Normatif menggunakan metode pendekatan perundang-undangan dan pendekatan kasus. Ketiga  putusan yang digunakan dalam penelitian ini sebagai bahan hukum primer yang dianalisis secara terperinci dengan pengertian-pengertian yang dianalisis dengan interpretasi gramatikal dan interpretasi sistematis. Berdasarkan hasil penelitian maka diketahui bahwa dasar pertimbangan hakim yang mengabulkan permohonan izin poligami dengan surat pernyataan menanggung resiko tidak dapat menyimpangi Pasal 4 ayat (2) Peraturan Pemerintah Nomor 45 Tahun 1990. Surat pernyataan menanggung resiko hanya suatu penjelasan tertulis tentang kondisi yang menerangkan bahwa calon istri kedua siap untuk menanggung resiko yang akan terjadi kemudian hari yang diakibatkan dari perkawinannya dengan pemohon. Surat pernyataan bersifat sepihak, tidak mengikat serta pernyataan dapat dicabut secara sepihak. PP Nomor 45 Tahun 1990 tidak mengizinkan pegawai negeri sipil wanita menjadi istri kedua dan seterusnya agar menghindari dari permasalahan rumah tangga yang akan muncul karena status istri dalam poligami mudah menimbulkan perselisihan dalam rumah tangganya yang akan mengganggu pegawai negeri sipil wanita selaku abdi negara dan abdi masyarakat dalam melakukan kewajiban yang diberikan kepadanya.Kata Kunci: Permohonan Izin Poligami, Pegawai Negeri Sipil, Dasar Pertimbangan Hakim ABSTRACT This research aims to analyse the judge’s basic consideration to grant a man to hold polygyny marriage with his second future wife who works as a civil servant under a written statement declaring the risk the wife promises to bear with regards to Article 4 Paragraph (2) of Government Regulation Number 45 of 1990. This is a normative juridical research employing statutory and case approach. All three decisions studied serve as primary materials analysed meticulously based on the definitions involved, grammatical and systematic interpretation. This research reveals that the letter stating the risk the woman promises to bear cannot serve as an alternative to Article 4 paragraph (2) of Government Regulation Number 45 of 1990 since this letter is restricted only to its capacity to declare that the second future wife is just ready to take the risk arising due to this polygyny marriage; this letter is made by only one party, not binding, and it is prone to revocation done unilaterally. The Government Regulation Number 45 of 1990 does not allow a woman working as a civil servant to be a second wife or more in a polygyny marriage recalling that this marriage could spark conflict and further problems later in life and this arising dispute may affect the working performance and responsibilities of the woman as a civil servant. Abstract

Female civil servants are not allowed to become the second, third or fourth wife in Article 4 paragraph (2) of Government Regulation Number 45 of 1990, but before the existence of Government Regulation Number 45 of 1990, female civil servants could become the second, third or fourth wife of a man who was not a civil servant. Initially, the regulation of PP No. 10 of 1983 was amended by PP No. 45 of 1990 to include a prohibition on female civil servants becoming the second, third or fourth wife of either male civil servants or non-civil servants. There are several decisions in the Religious Courts, where judges decide on requests for polygamy permits that do not comply with the regulations regarding polygamy. Some of these decisions include Decision Number 0085/Pdt.G/2019/PA.Sel, 0306/Pdt.G/2017/PA.Gtlo and 0102/Pdt.G/2016/PA.Dgl. In the decision on the polygamy permit application, there was a discrepancy between the provisions of Article 4 paragraph (2) of Government Regulation Number 45 of 1990 and the three judge's decisions above. The existence of a polygamy permit granted which is not based on the provisions contained in Article 4 paragraph (2) of PP Number 45 of 1990, namely the second wife candidate of the applicant who applies for a polygamy permit has a status as a Civil Servant. The result of this study is the judge's consideration in granting the applicant's request for permission to polygamy with a woman who is a civil servant is by submitting a statement letter ready to bear the risks caused by his marriage to the applicant. The judge overruled Article 4 Paragraph 2 of Government Regulation Number 45 of 1990 on the condition that the parties make a statement to bear the risk. The risk in question is dishonorable dismissal as a civil servant and the marriage can be annulled by the relevant agency or official. The parties must know and understand the risks they will face in applying for a polygamy license where the second wife is a woman who is a civil servant.
