Haryono No. 169 Malange-mail: dizaarifani@gmail.com  ABSTRAK Penelitian ini bertujuan untuk menganalisis status hukum perjanjian Artemis Accords terhadap Hukum Ruang Angkasa Internasional dan implikasi hukum perjanjian Artemis Accords terhadap Negara anggota Outer Space Treaty 1967. Adapun jenis penelitian yang digunakan oleh penulis yaitu jenis penelitian yuridis normatif dengan metode pendekatan perundang-undangan (statute approach). Teknik penelusuran bahan hukum dilakukan dengan penelusuran terhadap studi kepustakaan maupun studi dokumentasi yang didapat melalui perpustakaan dan internet. Teknik analisis bahan hukum menggunakan teknik deskriptif-analisis. Berdasarkan hasil penelitian dapat diketahui bahwa perjanjian Artemis Accords adalah perjanjian yang inovatif dan memiliki kelebihan yang tidak dimiliki Outer Space Treaty 1967. DÂÂisamping itu, Artemis Accords tidak sah karena  beberapa ketentuan yang ada di dalam perjanjian Artemis Accords menyimpang dari prinsip-prinsip Hukum Ruang Angkasa Internasional berdasarkan pada Outer Space Treaty 1967 dan Moon Agreement terutama prinsip freedom of exploration and use dan prinsip non-appropriation. Beberapa ketentuan dalam perjanjian Artemis Accords ada yang menyimpang dari prinsip Hukum Ruang Angkasa Internasional terkait pembagian data ilmiah, penetapan zona aman, dan ekstraksi sumber daya ruang angkasa. Penyimpangan itu lah yang membuat Artemis Accords bisa dibatalkan berdasarkan Pasal 46 dan 53 Konvensi Wina 1969 dan prinsip jus cogens yang bisa diberlakukan untuk Artemis Accords. Perjanjian Artemis Accords akan lebih mementingkan Negara-Negara anggota yang melakukan kegiatan ruang angkasa di bawah Artemis Accords. Prosesnya juga dapat menimbulkan kesenjangan antara Negara maju dengan Negara berkembang dalam hal pembagian manfaat yang diperoleh dari kegiatan eksplorasi sumber daya ruang angkasa. Kata Kunci: Artemis Accords, Outer Space Treaty 1967, Hukum Ruang Angkasa Internasional, Prinsip-Prinsip Hukum Ruang Angkasa Internasional ABSTRACT This research aims to analyse the legal standing of Artemis Accords regarding International Space Law and its legal implication of Artemis Accords on the member states of Outer Space Treaty 1967. This research employed the normative-juridical method and statutory approach. The legal materials were obtained from library research or documentation from the Internet. All the data were analysed based on a descriptive technique. The research has found out that Artemis Accords are an innovative agreement with the provisions that the Outer space Treaty 1967 does not have. However, Artemis Accords are considered invalid since some of their provisions are deemed irrelevant to the principles of International Space Law according to Outer Space Treaty 1967 and Moon Agreement, especially regarding the principle of freedom of exploration and use and the principle of non-appropriation. The principles of International Space Law constitute the distribution of scientific data, the determination of safety zone, and the extraction of space resources. All these irrelevant elements have caused Artemis Accords to be cancelled according to Article 46 and 53 of the Vienna Convention 1969 and the principle of jus cogens that can be implemented for Artemis Accords. Artemis Accords prioritize the members running space activities under this agreement. However, the process involved can also spark gaps between the developed and developing countries in terms of the distribution of benefits obtained from the exploration of space resources.
