Abstract

Al-Imam al-Ghazali had an important role in contributing thoughts about the Maslahah. Among his books in the field of Usul fiqh is, al-Mankhul, Syifa’ Ghalil and al-Mustashfa, in his three books he writes about the Maslahah, although some are described globally in one of his scriptures while in another book is written in detail. This resulted in the scholars ' debate about the view of al-Imam al-Ghazali. In the book al-Mankhul maslahat mursalah used the term al-Istidlal al-Mursal is a maslahah that there is no recognition of a proposition as a maslahah and also no rejection as a maslahah, not including the type recognized by the Shara ' and not by the purpose desired by Shara'. In the Book of Syifa' Ghalil using the definition of maslahah that there is recognition of the Shara ' although there is no specific evidence that recognizes the Maslahah and in the book Al-Mustashfa is to keep the purpose of Shara ', the purpose of Shara The controversy of the concept of Maslahah in the three books, Imam al-Ghazali practised the Maslahah daruriyyat, Maslahah hajjiyyat in the emergency position, Maslahah hajjiyyat and maslahah tahsiniyyat that there is recognition of Shara '.

Abstract

This study was conducted to reveal descriptively through a qualitative approach about (1) How is the role of Al-Rosyid Islamic Boarding School in the development of BMT, (2) How is the form of the principle of sharia transactions at BMT Al-Rosyid Berkah Bersama, (3) How is the role of Islamic boarding schools in implementing the principle of sharia transactions at BMT Al-Rosyid Berkah Bersama. The research method used is a qualitative method with a field research approach. Qualitative research is carried out in original conditions and is in the form of new findings. The results of the study revealed that; (1) Recruiting several alumni of the Al-Rosyid Islamic boarding school, holding regular evaluations with BMT management to discuss problems and solutions that exist in the movements and activities at BMT Al Rosyid Berkah Bersama, socialize the importance of the sharia financing system to students and the community, participate in efforts to expand corporate wings and participate in fundraising. (2) Implementation of the principle of brotherhood (ukhuwwah), implementation of the principle of Justice ('adālah), implementation of the principle of benefit (maṣlahah), implementation of the principle of Balance (tawāzun) and implementation of the principle of Universalism (shumuliyyah). (3) Recruiting and attracting capable alumni in BMT, especially in the field of sharia transaction principles, holding an intensive personal approach to BMT members, preparing future BMT cadres who are good in the field of sharia transaction principles, and several other important roles.

Abstract

Distribution of productive zakat by providing working capital assistance in the form of goats for mosque congregations is one of the strategies for community economic empowerment that is very interesting to study. The very large number of mosques and prayer rooms is the reason for the importance of Baznas partnering with mosques in managing zakat through community empowerment mechanisms. This study aims: (1) To determine the role of BAZNAS in community economic empowerment in East Java. (2) To create a model of economic empowerment based on mosque congregations through the distribution of productive zakat BAZNAS East Java Province. This type of research is qualitative and the approach used is Community Development. Data collection techniques are observation, interviews, and FGD, to determine the validity of the data using data triangulation and adequacy of references. While the data analysis technique uses data reduction, data presentation and conclusions. The results of this study are (1) Baznas has a very important role in helping the government work together to alleviate poverty through productive zakat distribution programs through the mechanism of community economic empowerment. (2) Community Development Model is carried out through problem identification, conducting training and mentoring, providing revolving working capital and conducting regular supervision. The mosque-based community economic empowerment program through the distribution of productive zakat should be duplicated by all Baznas and mosques in Indonesia. To achieve this, sufficient and qualified human resources are needed to manage and supervise. Mazawa Study Program can be a partner in collaboration with Baznas in initiating and assisting mosque-based economic empowerment programs

Abstract

This study examines risk management and cash waqf development strategies in Islamic microfinance institutions, with empirical evidence from the Mawar Cooperative in East Java. The background of this research stems from the growing importance of cash waqf as a sustainable financial instrument in Islamic finance, particularly in microfinance institutions that aim to balance social and economic objectives. The Mawar Cooperative, as a registered nazhir (waqf manager), has successfully managed and developed cash waqf through direct and indirect investments, demonstrating a unique model for other institutions. The objective of this study is to analyze the risk management practices and strategic approaches employed by the Mawar Cooperative in optimizing cash waqf for community development. Using a qualitative case study method, the research collects data from financial reports, waqf distribution records, and interviews with cooperative stakeholders. The findings reveal that the Mawar Cooperative employs a dual investment strategy—direct investments in member financing and indirect investments through partnerships with Islamic financial institutions—to mitigate risks and ensure sustainable returns. The discussion highlights the cooperative’s adherence to regulatory frameworks, transparency, and innovative waqf utilization in education, da’wah, and economic empowerment. The novelty of this study lies in its empirical focus on a microfinance institution’s role in cash waqf management, offering practical insights for policymakers and Islamic financial entities. The study concludes that effective risk management and strategic waqf development can enhance financial sustainability and social impact, providing a replicable model for similar institutions.
