Abstract

In this modern age, one of the forms and movements of endowments that attracted the attention of scholars and scholars is cash waqf. In Islamic history, cash waqf developed well in the days of the Bani Mamluks and Ottoman Turks. Basically wakaf is an instrument maliyah, so wakaf not only serves as a mere ritual worship but also social function. Waqf is a form of a steady expression of faith and a high sense of solidarity among fellow human beings, so it is an attempt to manifest and maintain vertical relationships (hablun min Allah) and horizontal relationships (hablun min al-nas). In the context of Indonesia, the enactment of the Law of the Republic of Indonesia no. 41 of 2004 on Wakaf directed to empower wakaf which is one of the instruments in building the socio-economic life of Muslims. The presence of Wakaf Law is a momentum of wakaf empowerment productively. In this paper will be elaborated discussion of waqf in general, followed discussion of cash waqf, as well as views of the mujathid cleric about cash waqf.

Abstract

This paper aims to analyze the principles and concepts that must be done with the reform of Criminal Law in Indonesia and an overview of maqasid al-sharì'ah upon this reform. At the end of the paper, two things are concluded. First, to welcome the discussion on the Bill of the Criminal Code, several points of thought need to be considered: The adjustments to human rights and respect for freedom of expression based on the needs of modern times and should accommodate the existence of customary law. It also should emphasize that justice must take precedence over legal certainty. The Bill should emphasize that "the principle of no crime without fault" is a condition for sentencing, in addition to the "principle of vicarious liability" and "principle of strict liability" if determined by law. Second, in the view of Islamic Law, the formation of the Bill has fulfilled the principles of maqasid al-sharì'ah, in the form that the law aims to realize the benefit of humans, which is achieved by obtaining benefits for humans and rejecting everything that damages life, both in this world and the hereafter.   Abstrak: Tulisan ini bertujuan untuk menganalisa: (1) hal-hal yang harus dilakukan dengan pembaharuan Hukum Pidana di Indonesia, dan (2) tinjauannya dalam maqasid al-sharì’ah. Di akhir tulisan disimpulkan dua hal. Pertama, bahwa dalam rangka menyongsong pembahasan RUU KUHP, ada beberapa pokok-pokok pikiran yang perlu dipertimbangkan, sebagai berikut: (1) penyesuaian dengan hak asasi manusia dan penghormatan kebebasan berekspresi yang sesuai dengan perkembangan zaman selain serta mengakomodir eksistensi hukum adat, (2) perlunya penekanan bahwa keadilan harus lebih diutamakan daripada kepastian hukum, (3) perlunya penegasan bahwa “asas tiada pidana  tanpa kesalahan” sebagai syarat pemidanaan, disamping “asas vicarious liability” dan “asas strict liability” jika ditentukan oleh undang-undang. Kedua, dalam pandangan Hukum Islam pembentukan R-KUHP telah memenuhi prinsip-prinsip maqasid al-sharì’ah, berupa bahwa hukum bertujuan untuk mewujudkan kemaslahatan manusia yang dicapai dengan cara memperoleh kemaslahatan bagi manusia dan menolak segala hal yang merusak kehidupan, baik di dunia maupun di akhirat.
