Abstract

This article discussed the dynamics of the Supreme Court jurisprudence in the legal setting, the problems that want revealed is how the dynamics of the Supreme Court ruling in Islamic law and what the aspects of philosophical and sociological background is. The results obtained indicates that the decisions of the Supreme Court in the civil law of islam have experienced a shift from the traditional framework of islamic law (conventional fiqh) into the framework of positive law (legislation fiqh). The shift was marked by a strong legislative paradigm both at the level of the law application (rechtshandhaving) and the discovery of the law (rechtsvinding). The issue of of justice, gender equality, and human rights is assumed as the background factor of the dynamics thought of Islamic law in the Supreme Court.   Artikel ini mendiskusikan Dinamika Yurisprudensi Mahkamah Agung Ri dalam menetapkan hukum, permasalahan yang ingin diungkap adalah  bagaimana dinamika putusan Mahkamah Agung dalam bidang hukum islam dan apakah aspek-aspek filosofis dan sosiologis yang melatar belakangi terjadinya hal tersebut. hasil yang diperoleh menunjukkan bahwa putusan-putusan Mahkamah Agung dalam hukum perdata islam telah mengalami pergeseran dari kerangka hukum islam tradisional (fiqh konvensional) ke  kerangka  hukum  positif  (fiqh perundang-undangan).  Pergeseran  tersebut  ditandai oleh kuatnya paradigma legisme baik pada level penerapan hukum (rechtshandhaving) maupun penemuan hukum (rechtsvinding). Isu keadilan, kesetaraan gender, dan hAM diasumsikan sebagai faktor yang melatar belakangi dinamika pemikiran hukum Islam di Mahkamah Agung.

Abstract

This study examines the process of institutionalization of sharia principles in the economic field, along with the process of legislation and regulation in the national legal system. The scope of this study will rely on the existence, opportunities, and challenges of actualizing the Islamic economic system from the perspective of Indonesian legal politics. Specifically, this approach is carried out based on the authority of Islamic law and its existence as a source of law in Indonesia’s national legal order, with a sharp level of attention to the dynamics of regulatory policies on sharia economic business activities. Starting from the characteristics of Indonesian political legalism under the umbrella of the 1945 Constitution, which adheres to the concept of “unification and codification in a “unique way,” the study of sharia economics in Indonesian legal politics has also given birth to several knots that are “unique.” Theoretically, the concept of “unification” is a way for national legal politics to shape law in the condition of a pluralistic Indonesian nation. One principle that is used as a theoretical benchmark in this regard is how to carry out the process of legal unification in a pluralistic society that seeks to maintain a process of differentiation in a sustainable manner of sharia economics. Abstrak Penelitian ini menyoroti proses pelembagaan prinsip syariah dalam bidang ekonomi berikut proses legislasi dan regulasinya dalam sistem hukum nasional. Lingkup kajian ini akan bertumpu pada eksistensi, peluang dan tantangan aktualisasi sistem ekonomi syariah dalam perspektif politik hukum Indonesia. Secara spesifik, pendekatan ini dilakukan dengan bertolak pada otoritas hukum Islam dan eksistensinya sebagai sumber hukum dalam tertib hukum nasional Indonesia, dengan tingkat perhatian yang tajam pada dinamika kebijakan regulasi atas kegiatan usaha ekonomi syariah. Bertolak dari karakteristik legalisme politik hukum Indonesia di bawah payung UUD 1945 yang menganut konsep”unifikasi dan kodifikasi secara “unik,” kajian tentang ekonomi syariah dalam politik hukum Indonesia juga telah melahirkan beberapa kata simpul yang bersifat “unik.” Konsep “unifikasi” secara teoritik merupakan satu jalan bagi politik hukum nasional untuk membentuk hukum dalam kondisi bangsa Indonesia yang majemuk. Salah satu prinsip yang dijadikan tolak ukur teoritis dalam hal ini adalah bagaimana melakukan proses penyatuan hukum dalam masyarakat majemuk yang berupaya mempertahankan proses diferensiasi ekonomi syariah secara berkelanjutan. Abstract

The widespread of shari’a by-laws in some regencies and many cases of discrimination and persecution of certain religious sects empirically are the manifestation of hegemony of majority over those of minorities which has often been overlapped with agenda and interests of political elites and the ruling power. This paper describes a number of problem concerning the majority-minority relations in Indonesia, by tracing the historical roots of resolution on such cases in Medina Charter as the constitution of Islam and the 1945 Constitution as the Constitution of Indonesia. By using descriptive-analytic  approach, the author asserts that various forms of rejection and humiliation against religious minorities, both within the same religion as well as between different religions that takes places of the current is clearly in contrast to the spirit of Medina Charter and the 1945 Constitution. Facing such problem of religious majority-minority relations and their excesses and the reality of pluralism, state, in accord with the author’s conclusions, must take a dual role: The role of prevention in terms of keeping in harmony the relations between people of different religions/faiths, and of promotive one in implementing and advancing the noble universal values that favored by each religion.

Abstract

One of the most significant changes contained in the UU No. 11 Tahun 2012 One of the most significant changes contained in the UU No. 11 Tahun 2012 is to accomodate principles of restorative justice and the principle of diversion in the juvenile justice system . Nevertheless, the application of the principles of restorative justice in the juvenile justice system are set out in the UU No. 11 Tahun 2012, tend to be partial and non-exhaustive . This is caused by the presence of common misconceptions in the understanding of restorative justice as an attempt to seek a peaceful settlement of the conflict out of court . This study shows that restorative justice is essentially complement rather than replace the criminal justice system . Therefore , restorative justice programs can be integrated into the whole process of juvenile justice without compromising the basic principles and main objectives of restorative justice , and at the same time , did not downplay the role of juvenile justice system that is based on formal legal requirements.
