Abstract

AbstractThe role of the people is needed to the achievement of development, because the success of development in a country is how the government determines empowerment models to community. Furthermore Indonesia will deal with public of the ASEAN economic MEA) on 2016, aimed at as an effort to to increase stability the economy in ASEAN. The research is the qualitative study to the source of the data in the form of a source of primary and secondary data. Research locations in East Java which includes several districts whose were selected purposively. Primary and secondary data collected through a method of interactive and non interactive and analyzed by using analysis interactive and flows. Required continuity between the local government and communities to the face challenges MEA. Disquiet fishermen when it comes to develop businesses is where marketing their products. The regional government should creating regulations related system resinous warehouse to cut the “tengkulak” a highly lethal businesses fishermen in ensure the availability of business capital for the production of continuing; control the availability of their food needs of the regions and stabilize commodity prices. Keywords: Fishermen, Local Governments, the Asean Economic, Resinous Warehouse AbstrakPeran masyarakat sangat dibutuhkan untuk tercapainya tujuan pembangunan, karena keberhasilan pembangunan ditentukan oleh tingkat partisipasi masyarakat dan pemerintah menentukan model pemberdayaan kepada masyarakatnya. oleh sebab itu, Kebijakan Pemerintah Daerah dalam pembangunan harus dilakukan melalui upaya-upaya yang serius. Lebih lagi Indonesia akan menghadapi Masyarakat Ekonomi ASEAN (MEA) pada tahun 2016, yang bertujuan sebagai salah satu upaya untuk meningkatkan stabilitas perekonomian di kawasan ASEAN. Memunculkan masalah diantaranya bagaimana kebijakan serta faktor apa saja yang menjadi kendala penguatan bagi masyarakat pesisir oleh Pemerintah Provinsi Jawa Timur. Penelitian ini merupakan penelitian kualitatif dengan sumber datanya berupa sumber data primer dan data sekunder. Lokasi penelitian di Jawa Timur yang meliputi beberapa kota/kabupaten yang ditentukan secara purposive. Data primer dan sekunder dikumpulkan melalui metode interaktif dan non interaktif serta dianalisis dengan menggunakan analisis interaktif dan mengalir. Diperlukan kesinambungan kerjasama antara pemerintah daerah dan masyarakat guna menghadapi tantangan MEA. Keresahan nelayan ketika ingin mengembangkan usaha adalah tempat pemasaran hasil produknya. Pemerintah daerah harus membuat regulasi terkait sistem resi gudang guna memangkas jalur tengkulak yang sangat mematikan hasil usaha nelayan dalam menjamin ketersediaan modal usaha untuk produksi yang berkelanjutan; mengendalikan ketersediaan kebutuhan pangan daerah dan menstabilkan harga komoditi. Kata Kunci: Nelayan, Pemerintah Daerah, Masyarakat Ekonomi ASEAN, Resi Gudang

Abstract

The purpose of this research is to study and analyze the Dilemma Problems of Regional Representative Institutions in the Indonesian State Administration System, in this case the DPD which is a State institution in the category of state institutions using normative juridical categories through licensing in accordance with the demand (statute approach) and conceptual (approach conceptual), thus the DPD obligation related to the implementation of regional autonomy which is limited to providing an assessment also shows the weakness of the DPD's function because it cannot fight for regional interests in increasing the DPD's consideration which is not followed up by the DPR Tujuan dari penelitian ini adalah untuk meninjau dan menganalisis Persoalan Dilematis Lembaga Perwakilan Daerah Dalam Sistem Ketatanegaraan Indonesia dalam hal ini DPD yang merupakan lembaga Negara yang masuk kategori main state organ dengan menggunakan metode yuridis normatif melalui pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conseptual approch), bahwa Kewenangan DPD berkaitan dengan penyelenggaraan otonomi daerah yang sebatas memberikan pertimbangan pun menampakkan kelemahan fungsi DPD karena tidak dapat memperjuangkan kepentingan daerah terhadap kemungkinan pertimbangan DPD yang tidak ditindaklanjuti oleh DPR

Abstract

This research focuses on two discussions, first, to analyze the arrangement of accident insurance for two-wheeled motor vehicles as a mode of online-based public transportation in Law No. 22 of 2009 on Traffic and Road Transportation (LLAJ Law). Second, to analyze the mechanism of insurance fulfillment for losses arising from the accidents of two-wheeled motor vehicle as an online-based public transportation mode. This research is a normative legal study. It concludes that first, PT. Jasa Raharja cannot provide protection for people who take the two-wheeled motor vehicles as a means of public transportation, because such vehicles are not included as the public motor vehicles according to the LLAJ Law. However, the providers of public transportation services with two-wheeled motor vehicles as the means of transportation can partner-up with the private insurance companies, or they can provide their own insurance system. Second, if the insurance is not provided, then public transportation service providers can be deemed as default based on the terms and conditions that have been made. Improvements to the LLAJ Law are necessary especially regarding the unclear provisions relating to the accountability of public transport companies and technology-based application provider companies.
