Abstract

In criminal law, a person charged with a criminal offense may be punished if it meets two matters, namely his act is unlawful, and the perpetrator of a crime may be liable for the indicated action (the offender's error) or the act may be dismissed to the perpetrator, and there is no excuse. The reasons may result in the death or the removal of the implied penalty. But it becomes a matter of how if the Letter of Statement Khilaf is the answer to solve the legal problems. The person who refuses or does not do what has been stated in the letters is often called "wanprestasi" because the statement is categorized as an agreement. The statement includes an agreement which is the domain of civil law or criminal law, so its application in the judicial system can be determined. This should be reviewed in the application of the law, are there any rules governing wrong statements in the criminal justice system. By using a declaration of khilaf as a way out of criminal matters, then the statement should be known in juridical rules. This study uses normative juridical methods, by conceptualizing the law as a norm rule which is a benchmark of human behavior, with emphasis on secondary data sources collected from the primary source of the legislation. The result of this research is that the statement of khilaf has legality, it is based on Jurisprudence No. 3901 K / Pdt / 1985 jo Article 189 Paragraph (1) of Indonesian criminal procedure law. However, this oversight letter needs to be verified in front of the court to be valid evidence, but this letter of error is not a deletion of a criminal offense, because the culpability of the defendant has justified the crime he committed. Such recognition, cannot make it free from the crime that has been committed.Keywords: Legality, Letter of Statement, Criminal Justice System

Abstract

Forest destructions has been escalating worldwide, including in Indonesia. Therefore, the Government issued Law Number 18 / 2013 on the Prevention and Eradiction of Deforestation (P3H) which was expected to guarantee legal certainty with emphasis on eradication of organized forest destruction. The problem to be discussed in this paper is about law enforcement and application of Law Number 18 / 2013 which frequently used to criminalize the indigenous people in Indonesia. The indigenous people have been criminalized on the ground of unlawful forest products utilization, while they merely foraging to fulfill their basic necessities. The criminalization of indigenous people is a conclusive evidence, which proof that Indonesian Goverment has been neglecting the indigenous people’s right. This paper use normative approach. The conclusion of this paper analyze that the problem of the criminalization happens in implementation level, which caused by the ignorance of law enforcement apparatus and vested interest.

Abstract

These days, crimes against personal data are not uncommon in society, necessitating a legal foundation to provide legal protection for individuals' privacy rights. The enactment of the Personal Data Protection Act brings a breath of fresh air to the community, but its comprehensive implementation is still not possible due to the absence of an authorized institution under this law. This research aims to discuss the importance of a personal data protection institution in ensuring the security of individuals' personal data. The study is of a normative nature and employs a statutory approach and a historical approach. The research findings indicate that the substantive provisions of the personal data protection law have sufficiently addressed the need for personal data protection for the community. However, these regulations have not been fully implemented due to the lack of a clearly defined institution in the law, resulting in delays in the establishment of such an institution. Therefore, it is necessary to have regulations that govern the inclusion of a supporting state institution in a law, in order to establish the desired standardization and avoid a lack of provisions that impede the formation of the institution

Abstract

Sejalan dengan perkembangan zaman yang begitu cepat, kesenjangan ekonomi semakin tinggi sehingga hal tersebut menyebabkan kriminalitas yang sangat tinggi di Indonesia yang berampak pada tingkat overkapasitas yang tinggi di RUTAN dan LAPAS seluruh Indonesia. Maka dari itu Indonesia perlu sebuah penyelesaian perkara tindak pidana ringan yang tidak hanya fokus pada pidana pemenjaraan yang pada akhirnya hanya menyebabkan overkapasitas di RUTAN dan LAPAS dan menyebabkan tidak efektifnya fungsi dari Lembaga permasyarakatan. Restorative Justice merupakan sebuah alternatif penyelesaian perkara tindak pidana ringan yang lebih mementingkan keadilan hak-hak para pihak yang terlibat tanpa melalui litigasi sehingga perkara dapat diselesaikan dengan mediasi antara korban, pelaku dan pihak terkait sehingga tercapainya perdamaian dan hak korban dapat terjamin. Dalam implemetasi keadilan restoratif salah satunya yang dilakukan oleh Jaksa dalam penghentian penuntutan.

Abstract

In the realm of criminal law, it is acknowledged that criminal offenses may be perpetrated by a broad spectrum of individuals, including those with disabilities, spanning both mental and intellectual realms. The term “disability” includes individuals with physical or intellectual impairments who could not previously be sanctioned. However, Law No. 1 of 2023 has provided for the imposition of sanctions for people with mental or intellectual impairments. This study employs a normative research methodology, utilizing a statutory approach through the examination of various literature and journals focused on criminal law policy. Specifically, it addresses the implementation of incarceration for individuals with mental and intellectual disabilities. Through descriptive-analytical methods, this research highlights that Article 38 of the New Criminal Code expands the scope of criminal sanctions applicable to individuals with mental and intellectual disabilities. This provision appears to be at odds with Article 44 of the Criminal Code, which exempts persons with such disabilities from criminal liability, suggesting a contradiction where Article 38 permits the application of reduced penalties. The conclusion posits that while individuals with disabilities might be seen as not fully accountable under certain circumstances, leading to exemption from criminal penalties, a human rights perspective advocates for prioritizing social rehabilitation.
