The developmental program of the government creates delicate issues concerning the proper allocation of land. While the government program of welfare necessitates the availability of land to build housings, roads, factories and business centers, the plight of society displaced from their land should not be overlooked. Liberalist approach on managing land proves to bring more problem than solution to the society at large. Through the strong capital and wide network in executive and legislative bodies, the liberalist proponents manage to seize huge amounts of land at the expense of the original owners, mostly villagers who lack of apprehension about the price of land. The vague regulation concerning land also contributes to the handover of huge acres of land from the villagers to the capital owners. Without government intervention on the land market, it is worried that the process of land acquisition by the capital owner will run out of control.Keywords: Liberalisasi Ekonomi, Penguasaan Tanah, Hak Milik

Making a policy (regelgeving) is one of the functions of government. The fact that all citizens are always in contact with the public policy issued by governments, particularly concerning public interest. The development of the concept of state right to control the land started from the constitution which is then poured in the Agraria Law. Tenure by the State is not only done by the central government, but also by the local government through a process of devolution of authority in line with the spirit of regional autonomy laws. However, with the issuance of Government Regulation No. 38 of 2007, the fact that majority of the state's power in land still held by the central government on behalf of the state. This realitiy shows that the governenment failed to establish a decentralized system in the land sector.

Sementara di sisi lain program pemerintah untuk kesejahteraan membutuhkan ketersediaan tanah untuk membangun perumahan, jalan, pabrik pusat -pusat bisnis. Persoalan berat kepemilikan tanah yang dihadapi masyarakat harus mendapat perhatian.Pendekatan kelompok liberal terhadap pengaturan penguasaan tanah menimbulkan banyak persoalan bagi masyarakat secara luas. dengan menggunakan modal yang besar dan jaringan yang kuat di lembaga eksekutif dan legislatif, pendukung kelompok liberal mengambil alih kepemilikan tanah secara besar-besaran terutama dari penduduk desa yang tidak mengetahui harga tanah yang semestinya. Peraturan yang masih belum jelas berkaitan dengan tanah juga menyebabkan pindah kepemilikan dari petani ke pemilik modal. Tanpa intervensi dan kontrol dari pemerintah terhadap pemasaran tanah, dikhawatirkan persoalan penguasaan tanah oleh pemilik modal akan lepas kontrol.Keywords: Liberalisasi Ekonomi, Penguasaan Tanah, Hak Milik

The importance of land certificate as legal protection for land owners invites the attention of policy makers in this country. The policy which is issued by the government is to issue mass certifying program on land based on the Decree of Ministry of internal affair Number 189 year 1981 0n Agrarian National Operation Project (PRONA) implementing by National Defence Board as its duty. Basically, the program is implemented annually through some steps and processes, preparation, coordination/determination of Land Rights, right registration, certificate issuance and delivery of certificates. Obstacles which are faced by the District Land Office or City in implementing the program are in particular aspects such as society as the member of the program, the staff and financial aspect of the program itself. Pentingnya sertifikat hak atas  tanah sebagai perlindungan hukum bagi pemilik tanah mengundang perhatian para pemilik kebijakan di negeri ini. Kebijakan yang di keluarkan pemerintah salah satunya dengan mengeluarkan program pensertipikatan tanah secara massal berdasarkan Keputusan Menteri Dalam Negeri Nomor 189 Tahun 1981 tentang Proyek Operasi Nasional Agraria (PRONA) yang pelaksananya Badan Pertanahan Nasional sebagaimana tugasnya. Pada dasarnya pelaksanaan Program Prona dilakukan secara rutin tiap tahun melalui tahapan atau proses, persiapan, koordinasi/penetapan peserta PRONA, penyuluhan, pengukuran, pengumpulan data, pengumuman, penetapan Hak Atas Tanah, pembukuan hak, penerbitan sertipikat, dan penyerahan sertifikat. Since the reformation era, the government made the revolution in government administration to develop Indonesia. One of the revolutions is the issuance of Law no. 32 of 2004 on Regional Government; the authority of land is one of the law components. Previously, the authority of land is centered in the central government. Conversely, through the Article 10 paragraph (3) of Law No. 32 of 2004 on regional autonomy, the authority of the land sector should be submitted to the local government for its more understanding about the land nowadays. The transfer of authority is one of development step in Law aspect in Indonesia. Sejak era reformasi bergulir, pemerintah melakukan revolusi dibidang administrasi pemerintahan guna memajukan Negara Indonesia. Salah satu revolusi yang terjadi adalah dengan dikeluarkannya Undang-undang No. 32 Tahun 2004 tentang Pemerintahan Daerah, antara lain dibidang pertanahan. Semula kewenangan bidang pertanahan ini urusannya berada di pemerintah pusat. Namun di era reformasi ini melalui Pasal 10 ayat (3) UU No. 32 tahun 2004 tentang otonomi daerah, kewenangan bidang pertanahan sudah seharusnya diserahkan kepada pemerintah daerah yang lebih mengetahui kondisi pertanahan tersebut. Pengalihan kewenangan tersebut merupakan salah satu bentuk dari langkah pembangunan di bidang hukum di Indonesia.

Al-Qur'an and of Hadist represent guidance of public or made hold, according to Islam about levying of land for the sake of the public. In al qu'ran, expressed that Allah bestow big grant from above to human being by creating earth, natural resources and water which consist in in it to the human being to be used human being to be able to take care of the continuity of its life and so that human being devote to Allah of SWT, to family and to society. By its, land existence has to be utilized to its of prosperity of society as arranged in Section 33 sentence (3) UUD 1945.

E-contract is a new technology in online trading. It is a double-edged sword. Besides having advantages such as simplifying and speeding up transactions, it has shortcomings e.g. no legality regarding e-contract and substantive and procedural problems. One of them is in the application of clickwrap agreements, a standard agreement in e-commerce transactions. Buyers must agree with the requirements by clicking the “I agree†button. The research examines the legal protection and privacy policy for the users of smart contract clickwrap agreements in e-commerce transactions in Indonesia. This is normative research with a statute approach. This study teaches the readers to understand the shortcomings and to be more cautious about e-commerce transactions. The results reveal that privacy policy on the use of smart contract clickwrap agreement is based on the EIT Law meanwhile the international law aspect is UNCITRAL Model Law. It shows that e-contract basic guideline has law absence. Besides investigating the regulations, the researchers trace the principles of contract law which is applicable to realize justice and certainty of parties. To conclude, legal reformation is needed in managing the validity of the smart contract clickwrap agreement so there will be legal certainty in e-commerce transactions in Indonesia.E-contract merupakan teknologi baru yang diterapkan dalam perdagangan online. E-contract merupakan pedang bermata dua. Di samping memiliki banyak keuntungan seperti mempermudah dan mempercepat transaksi, namun ia juga memiliki kekurangan, seperti tidak adanya legalitas mengenai e-contract dan permasalahan yang bersifat substantif dan prosedural. Salah satunya ialah penerapan clickwrap agreement, bentuk perjanjian baku dalam transaksi e-commerce. Pembeli harus menyetujui persyaratan dengan mengklik tombol “I agreeâ€. Penelitian ini mengkaji perlindungan hukum dan kebijakan privasi bagi pengguna smart contract clickwrap agreement pada transaksi e-commerce di Indonesia. Metode yang digunakan ialah penelitian normatif dengan pendekatan perundang-undangan. Penelitian ini mengajarkan pembaca untuk lebih memahami kekurangan dan waspada dalam melakukan transaksi e-commerce. Hasil penelitian menunjukkan bahwa kebijakan privasi pada penggunaan smart contract clickwrap agreement berdasarkan UU ITE dan aspek hukum internasional yaitu UNCITRAL Model Law sebagai pedoman dasar e-contract masih memiliki kekosongan hukum. Selain menelusuri peraturang perundang–undangan peneliti juga menelusuri asas–asas hukum kontrak yang dapat diterapkan untuk mewujudkan keadilan dan kepastian para pihak. Dapat disimpulkan bahwa diperlukan pembaharuan hukum dalam pengaturan keabsahan smart contract clickwrap agreement agar terbentuk kepastian hukum dalam transaksi elektronik di Indonesia.

The problem of capital punishment in Indonesia as a country which has Pancasila philosophy is still a discussion which caused many different views until now. This problem arises because it is considered to be "violating" human rights, it is seen from the history of punishment that the death penalty was born together with the birth of man on the face of the earth, with the legal culture of "retalism" like wolves eating wolves, in which the criminal is based on the theory of absolute revenge (absolute theory) .The death penalty in terms of Islamic religion (Shari'at Islam) death is a penalty stipulated by Shari'a Islam with the decree of Allah SWT which can not be inviolable by anybody.Only what we need to learn in this case is the terms of its implementation so as not to easily impose the judgment of the law. means that according to Islamic views, the death penalty is merupaka n criminal offenses that are formally required to be held. The death penalty that is done according to the correct Islamic religious provisions is not: contrary to the philosophy of the State, is not: contrary to the elements of Belief in God Almighty, because Islamic sha'at is a Shari'ah based on Belief in the One Supreme. Masalah hukuman pidana mati di Indonesia sebagai suatu negara yang mempunyai falsafah Pancasila, masih merupakan suatu pembicaraan yang banyak menimbulkan berbagai perbedaan pandangan sampai sekarang Permasalahan ini muncul karena dianggap "melanggar'' hak asasi manusia. Ditinjau dari sejarah pemidanaan, bahwa hukuman mati lahir bersamasama dengan lahirnya manusia di muka bumi ini, dengan budaya hukum "retalisme" bagaikan serigala memakan serigala. Mada masa itu berlaku pidana berdasarkan pada teori pembalasan mutlak (teori absolut). Hukuman mati ditinjau dari segi agama Islam (Syari'at Islam) sudah jelas bahwa hukuman mati itu adalah pidana yang ditetapkan oleh Syari' at Islam dengan dekrit Allah Swt yang sama sekali tidak boleh diganggu gugat oleh siapapun juga. Hanya yang perlu kita pelajari dalam hal ini adalah syarat-syarat pelaksanaannya agar tidak dengan mudah menjatuhkan putusan hukum itu. Hal ini berarti bahwa menurut tinjauan agama Islam, maka hukuman mati itu adalah merupakan pidana yang secara resmi perlu diadakan. Hukuman mati yang dilakukan menurut ketentuan-ketentuan agama Islam yang benar adalah tidak: bertentang dengan falsafah Negara, tidak: berlawanan pula dengan unsur-unsur Ketuhanan Yang Maha Esa, karena syai'at Islam mempakan syari'at yang berdasarkan Ketuhanan Yang Maha Esa.

The state of Indonesia is a state based on law (rechtstaat) and not based on mere power (machststaat). This implies that the state, including the Government and other state institutions in carrying out any action must be lawful or legally accountable. Human rights are principally universally applicable, but their applications vary greatly according to the style and basic attitudes of cultures adopted by a nation. Human rights in the country of Indonesia starting from the disappearance of East Timor post-opinion that accuses the involvement of the Indonesian military is behind it, the new draft law (RUU) is based on an agreement between the drafting team of the bill consisting of experts and legal practitioners and Parliament will impose these laws will retroactively apply indefinitely. Negara Indonesia adalah negara yang berdasarkan atas hukum (rechtstaat) dan tidak berdasarkan atas kekuasaan belaka (machststaat). Ini mengandung arti bahwa negara, termasuk didalamnya Pemerintah dan lembaga-lembaga negara yang lain dalam melaksanakan tindakan apapun harus berdasarkan hukum atau harus dapat dipertanggungjawabkan secara hukum. Hak Asasi Manusia pada prinsipnya berlaku secara universal, hanya saja aplikasinya sangat bervariasi sesuai dengan corak dan sikap dasar budaya yang dianut oleh suatu bangsa. Hak Asasi Manusia dinegara Indonesia mulai dari pembumi-hangusan Timor Timur pasca pendapat yang menuding keterlibatan militer Indonesia berada dibelakang semua itu, baru rancangan undang-undang (RUU) inilah berdasarkan kesepakatan antara tim penyusun RUU yang terdiri dari pakar dan praktisi hukum dan DPR akan memberlakukan undang-undanng ini nantinya berlaku surut (retroactive) tanpa batas waktu.

Every product of legislation that has been issued or ratified, must be obeyed by the Indonesian people, both individually and in groups. In order for every regulation issued by the community to be obeyed by the community, it must meet several conditions, namely: the regulations to be and/or made must really accommodate what the culturally diverse community wants. However, the things that are accommodated must be those that do not interfere with the development of society, nation and state. After the regulation is issued or ratified, in order to run well in the sense of being obeyed by the wider community, it must be equipped with proportional law enforcers and really have an enforcement spirit so that the regulations that are followed can be implemented consistently and justice will be achieved, both according to the regulations. themselves and according to society. Setiap produk peraturan perundang-undangan yang telah dikeluarkan atau disahkan, seharus ditaati oleh masyarakat Indonesia baik secara individual maupun secara kelompok. Agar setiap peraturan yang dikeluarkan tersebut di taati oleh masyarakat maka harus memenuhi beberapa syarat, yaitu: peraturan yang akan dan/atau dibuat itu harus benar-benar mengakomudasi apa yang di inginkan oleh masyarakat yang beragam budaya tersebut. Akan tetapi hal-hal yang diakomodasi itupun harus yang tidak mengganggu perkembangan masyarakat, bangsa dan negara. Setelah dikeluarkan atau disahkan peraturan tersebut, agar dapat berjalan dengan baik dalam arti dipatuhi oleh masyarakat luas, harus dilengkapi dengan penegak hukum yang proporsional dan benar-benar mempunyai jiwa penegak sehingga peraturan yang dijalani dapat terlaksana secara konsekuen dan akan tercapai keadilan, baik menurut peraturan itu sendiri maupun menurut masyarakat.
