Abstract

This paper is carried out in order to study and evaluate the existing of governmental policies and the strategies of Indonesian government for conservation of forest and protective areas and it is also to formulate a sustainable development strategy for forest and protective areas. This study is related with the enactment of the No. 19 Act in 2004 which is implemented in the forest areas, as a new regulation of forestry especially for 13 companies which got the permission in accordance with Presidential Decree No. 41 in 2004 which is a manifestation of synchronization of mining activities in the forest areas. The method of this paper is used a normative legal research to study and evaluate the governmental policies and strategies which deal with mining activities in the forest areas. In this paper I analize a normative vagueness between two Acts, that is No. 11 Act in 1967 as the law of mining and No. 41 Act in 1999 as the law of forestry regarding utilization of forest and conservative forest to overlapping the mining activities. From the result of this study I concluded that in reality the mining is one of the causes of forest destruction. Walhi indicated that the mining locations clearly visible how the face of Indonesian forests are destroyed by excavation, disposal of waste rock and tailing and after mine operation support of the activities and they left about the holes were allowed to continue to open and become toxic acid at the post-mining lake. From the review above for addressing the threat need to formulate a sustainable development strategy for forest and protective areas at least need to revitalize the effort to required legislation concerning forest and conservation of biodiversity for mining activities in the forest areas.

Abstract

Since 2003 year the technic of agroforestry with alley cropping systems has been implemented at the forest areas in Pejarakan Village, District Gerokgak, Regency of Buleleng Province Bali. These activities are expected to support the progress of welfare for farmers, eventhough they have been neglected to preserve forest around village. After the research it was cleared that the result of activities didn't fulfilled to its expectation. The analysis about the compositions and structures of vegetations in this research shows that the dominant type of species which are mainly cultivated have character of Importance Value Index, the balance of species among Diversity Index are still low at all of the communal forest areas and even at the these slope sides. The composition and the structure of species were still few, and the vegetation it self was disturbed by people, in order to illegal longings, cuttings top branches or twigs often occur, and these activities obstacle growth of trees in communal forest areas. It is concluded that the technic of agroforestry at the communal forest areas has few compositions of species and structure of vegetations, so the diversity of species become very poor and not stable either for plants in forestry or for agricultural crops. The researcher could not determine that what species of vegetations superior at this area. So it necessary to enough time for intensive observations and research at this communal forest areas.

Abstract

The purpose of this study was to examine the impact of deforestation on biodiversity loss in Indonesia. Firstly author presented information about deforestation trends that spread across Indonesia. And presented information about forest fires that triggered off the continuous deforestation and occurred one after another throughout the year. The collected data showed deforestation and forest fires have occurred since 1960 to 2015, and deforestation and forest fires implicated in the extinction of species diversity, genetics, and ecosystems that spreads from Sunda region to Sahul region.  Author used descriptive regulation and legislation methods, used literature approach, as well as arranged with descriptive and interpretational form in papers. From the results of this study author concluded that deforestation rate implicates in forest fires that occur continuously throughout the year and can not be inevitable possibility of extinction of biodiversity spread across Indonesia.

Abstract

Community’s participation in development has been made since the enactment of 1945Constitution and constitutionally it has clear reference and it becomes the obligation ofanybody involved in the management of natural resources in Indonesia. However theparticipation of the community in the development in the reform era has shown the tendencyof running imperfectly. What is the condition of the community’s participation from thebeginning up to now does not yet have clear position in the form of authority and obligationand the right as community in making their participation in running the government is put intoa study. The method employed for the study is library research by using secondary datacoming from literatures, mass media, the specifications of legislations; comperative study wasalso made from various opinions and the understanding of community’s participation. Anumber of variables to be studied among others are: the specification of legislation, role ofgovernment, form of interaction of the implementation of community’s participation, andefforts made by the government within the context of community’s participation so thatdevelopment can be increased. From the study of the implementation of the legislationsinvolving community’s participation since old order until the regional autonomy era it has notyet run effectively and efficiently.
