<![CDATA[ABSTRAK Penelitian ini bertujuan untuk untuk menganalisa dan mengetahui bagaimana prosedur penyidikan dalam pengadilan HAM, khususnya prosedur penanganan ketidaklengkapan hasil penyidikan pelanggaran HAM berat yang oleh jaksa agung yang bertugas sebagai penyidik kepada jaksa agung yang bertugas sebagai penuntut umum. Pada karya ilmiah ini menggunakan metode “penelitian normatif”. Dalam penelitian kali ini menunjukkan bahwa mengenai prosedur pengembalian berkas perkara oleh penuntut umum kepada penyidik mengikuti proses prosedur dalam melengkapi hasil penyidikan dengan memperhatikan Pasal 22 ayat (1) sampai dengan Pasal 22 ayat (5) UU Pengadilan HAM dan diperjelas dalam pengaturan mengenai proses pengembalian berkas penyidikan yang terdapat dalam KUHAP sebagai lex generalis dari UU Pengadilan HAM.
