Abstract

The purpose of this research is to know and understand the regulation of mineral and coal mining business implementation conducted by foreign investors before the birth of Rule Number 1 Year 2017 and to know and understand the implication of the birth of Regulation No. 1 of 2017 is hurt with the aim of the state. In this research, to reach the objective, normative research method with regulatory approach is applied by reviewing the laws and regulations related to research and case approach related to the divestment of mining business by foreign investors. The conclusion yields two conclusions. The first conclusion is the regulation of the implementation of mineral and coal business activities prior to the issuance of Government Regulation No. 1 of 2017 is regulated in several laws and regulations which have two weak points. The first concerns the regulation of inconsistent divestment shares and both mechanisms of work contracts that are detrimental to the Government of Indonesia. the second conclusion, the issuance of Government Regulation No. 1 of 2017 confirms the number of divestment shares and changes in working contract patterns to mining business permits maximizing the realization of welfare for all Indonesian people.

Abstract

LPD secara materil melaksanakan aktifitas perbankan sehingga risiko yang dihadapi lembaga perbankan juga akan dihadapi LPD, sehingga mengatur dan menerapkan prinsip-prinsip perbankan menjadi suatu keniscayaan. Prinsip mengenal nasabah merupakah salah satu prinsip perbankan yang penting dan strategis dilakukan lembaga keuangan untuk mencegah risiko usaha khususnya risiko eksternal khususnya tindak pidana pencucian uang. Namun dewasa ini dalam Peraturan daerah provinsi Bali No 3 Tahun 2017 tentang Lembaga Perkreditan Desa belum mengatur secara khusus tentang prinsip mengenal nasabah. penelitian ini menggunakan metode penelitian normatif yang secara khusus mengkaji peraturan perundang-undangan dan literatur yang berkaitan dengan urgensi pengaturan prinsip mengenal nasabah dalam LPD. Berdasarkan hasil penelitian daapat ditarik 2 (dua) kesimpulan. Pertama, pengaturan prinsip mengenal nasabah dalam LPD di Bali secara rasional dapat dilihat dari 3 (tiga) pilihan, yaitu pilihan nilai, pilihan motif, dan pilihan cara. Kedua, konstruksi pengaturan prinsip mengenal nasabah pada LPD sekurang-kurangnya terdiri dari: identifikasi dan verifikasi calon nasabah dan nasabah; pemilik manfaat; manajemen risiko; area berisiko tinggi dan pemantauan transaksi nasabah dan pengkinian data nasabah, penatausahaan dokumen, dan pelaporan. LPD materially carries out banking activities so that the risks faced by banking institutions will also be faced by the LPD, so that regulating and applying banking principles becomes a necessity. The principle of knowing customers is one of the important and strategic banking principles carried out by financial institutions to prevent business risks especially external risks, especially money laundering. But nowadays in the provincial regulation of Bali No. 3 of 2017 about Village Credit Institutions have not specifically regulated the principle of knowing customers. This study uses normative research methods that specifically examine legislation and literature relating to the urgency of setting the principle of knowing customers in the LPD. Based on the results of the research, you can draw 2 (two) conclusions. First, the rational arrangement of knowing customers in LPDs in Bali can be seen from 3 (three) choices, namely choice of values, choice of motives, and choice of methods. second, the construction of the principle of knowing customers in the LPD consists of at least: identification and verification of prospective customers and customers; benefit owner; risk management; high risk areas and monitoring customer transactions and updating customer data, administering documents, and reporting
