Abstract

Tujuan dari penelitian ini yaitu untuk mengetahui pengaturan hak cuti melahirkan terhadap pekerja perempuan dan bentuk implementasi perlindungan hukum hak cuti melahirkan terhadap tenaga kerja perempuan di Villa Surya Mas. Adapun metode yang digunakan adalah metode penelitian hukum empiris, yakni penelitian yang dilakukan secara langsung guna melihat bagaimana hukum bekerja secara langsung di lapangan (das sollen dengan das sein). Hasil penelitian menunjukan bahwa pengaturan dalam melindungi hak cuti melahirkan terhadap pekerja perempuan yang termuat dalam Pasal 82 Undang – Undang Ketenagakerjan sudah berjalan sesuai dengan praktek dilapangan, yaitu Villa Surya Mas memberikan hak cuti melahirkan kepada pekerja perempuanya berupa satu setengah (1,5) bulan sebelum melahirkan serta 1,5 bulan lagi sesudah melahirkan tanpa adanya pemotongan gaji. The purpose of this study is to find out the arrangement of maternity leave rights for female workers and implementation of legal protection of maternity leave rights against women workers in Villa Surya Mas. The method used is empirical legal research method, which is research conducted directly to see how the law works directly in the field (das sollen with das sein). The results showed that the arrangements in protecting maternity leave rights for female workers are included in Article 82 of the Labor Law already running in accordance with the practice in the field, namely Villa Surya Mas gives maternity leave rights to female workers in the form of one and a half (1.5) months before giving birth and another 1.5 months after giving birth without a pay cut.
