Abstract

This article attempts to explain briefly associated with a set of issues relating to cyberterrorism. It also needs to think about the future of criminal law anticipatory policy in the mengelminir cyberterrorism as a trend of crime in the future. Analysis showed that the Cyberterrorism is a form of transformation of terror carried out by terrorists by making the Internet as a tool or target of the attack . This type of crime morphed into a cross- country crime. The culprit could come from any area of ​​the country that legal consequences on the identity of the implications for the determination of the court's jurisdiction. With this advanced enough pattern of cooperation that is needed is globaly. One solution every country must synchronize on legislation that specifically regulates cyberterror . Keywords: Criminal Policy, Cyberterrorism, State. Artikel ini berupaya menjelaskan secara ringkas berkaitan dengan seperangkat isu-isu yang berkaitan dengan cyberterrorism. Selain itu juga kedepan perlu dipikirkan tentang kebijakan antisipatif hukum pidana dalam mengelminir terjadinya cyberterrorism sebagai trend of crime kedepan. Analisa menunjukan bahwa Cyberterrorism merupakan bentuk transformasi terror yang dilakukan oleh teroris dengan menjadikan jaringan internet sebagai alat atau sasaran serangan. Jenis kejahatan ini bermetamorfosis menjadi kejahatan yang bersifat lintas negara. Pelakunya bisa berasal dari wilayah negara mana saja yang berakibat hukum pada identitas yang berimplikasi pada penentuan jurisdiksi pengadilan. Dengan pola yang cukup maju ini maka dibutuhkan kerjasama yang bersifat global atau internegara. Salah satu solusinya setiap negara harus melakukan sinkronisasi tentang peraturan perundang-undangan yang khusus mengatur tentang cyberterror. Kata Kunci: Kebijakan Pidana, Cyberterrorism, Negara

Abstract

This study was to determine the criminal liability for the actors of participants who did not have personal qualities in corruption and to find out the legal considerations of judges in court decisions against the actors of participants who did not have personal qualities in criminal acts of corruption. The research method used was a normative legal research method. Participants who had no personal quality could be held crimanally accountable, the basis of the consideration was first because there was no clear legal basis and secondly supported by the opinions of several experts in criminal law. The relationship of each participant was not separate from one another but becomes a unity, meaning that one actors could also determine the other actors accountability. A clarity was needed on whether or not perpetrators who did not have personal qualities were accountable for their actions, namely by making legal decisions that remain jurisprudential or making new articles formulated in the upcoming law on corruption eradication.

Abstract

This study aims to identify and analyze the modus operandi of cyberbullying and to analyze methods of overcoming cyberbullying. The method in this study is a normative research method using a conceptual approach, legislation, case approach. The results of this study include: The modus operandi of cyberbullying can be divided into several parts, namely: Exclusion, Flaming, Impersonation, Trickery, Fraping, Dissing, Cyberstalking (mental attack). Methods of overcoming cyberbullying can be done penal and non-penal. The method of overcoming through penal means in general can be identified through the Criminal Code (KUHP) in Articles 310, 311 and 315 of the Criminal Code. Meanwhile, it is specifically regulated in Law Number 19 of 2016 concerning Amendments to Law Number I1 of 2008 concerning Information and Electronic Transactions in Article 27 (paragraph 1), 3), 4), Article 28 paragraph 2), and Article 29 The criminal provisions of these articles are regulated in CHAPTER XI concerning criminal provisions in Law Number I1 of 2008 concerning Information and Electronic Transactions. Non-penally, overcoming cyberbullying consists of several parts, namely: a cultural approach, a moral approach, a scientific approach, and a technology approach.

Abstract

This research is a normative legal research that aims to analyze the concept of the crime of extortion and threats through social media in the formulation of Article 27 paragraph (4) of the ITE Law and to analyze the considerations of judges in acquitting decisions (vrijspraak) against cases of criminal acts of extortion and threats through social media in Mataram District Court Decision No. 272/Pid.Sus/2019/PN.Mtr. The results of the research are analyzed that the previous offense of extortion and threats (afpersing en afdreiging) in the Criminal Code were two different crimes, but the ITE Law formulates the crime of extortion and threats in one formulation of the Article. Extortion and threats carried out through electronic media use the element of extortion as the first element because extortion is the substance, while threats are a method used by perpetrators to carry out acts of extortion. In the acquittal (vrijspraak) against the criminal act of extortion and threats through social media in the Mataram District Court Decision Number 272/Pid.Sus/2019/Pn.Mtr that at the trial the Defendant explained the intent and purpose of the Defendant in providing comments on Social Media was so that funds Earthquake assistance was quickly realized by the Regional Government of Kab. North Lombok, Another consideration is that based on proven legal facts, the defendant's posting on his Facebook account was not motivated by extortion and the defendant did not get any benefit, therefore the element of extortion and/or threats was not proven.
