Abstract

Abstract: This article elaborates on the concept of a fair and prosperous among the Indonesian founding fathers with the Muslim philosophers. Basic concepts of the founding fathers is Pancasila in which there is the word ‘fair’. The word ‘fair’ is also a very serious discussion among Muslim philosophers. The Muslim philosophers underlined that fair is one of the basics of leadership exemplified by the Prophet Muhammad while leading the people of Madina multi-ethnic and multi-religious, and this of course is relevant to the context of Indonesia's multi-religious, multi-ethnic and multi-class. For founding fathers, desire to create a fair society and a prosperous lofty ideals and key for the Indonesian nation. Therefore, they feel how much suffering people of Indonesia as a nation occupied by foreign interchangeably. In the occupation of Indonesia was treated unfairly, and natural wealth confiscated. This goal was already thought by the Muslim philosophers. Therefore, in comparing the two is where the significance of the concept of a just and prosperous one. Abstrak: Artikel ini akan mengelaborasi konsep negara adil dan makmur antara founding fathers (Para Pendiri Bangsa) Indonesia dengan para para filosof Muslim. Asas konsep founding fathers adalah Pancasila yang di dalamnya terdapat kata adil. Kata adil juga menjadi pembahasan yang sangat serius di kalangan filosof Muslim. Para filosof Muslim menggarisbawahi bahwa adil merupakan salah satu asas kepemimpinan yang diteladankan oleh Nabi Muhammad saat memimpin masyarakat Madinah yang multi-agama, dan ini tentu saja relevan dengan konteks Indonesia yang multiagama, multi-etnik, dan multi-golongan. Bagi founding fathers, keinginan mewujudkan masyarakat yang adil dan makmur merupakan cita-cita luhur dan utama bagi bangsa Indonesia. Sebab, mereka merasakan betapa menderitanya bangsa Indonesia ketika dijajah oleh bangsa asing yang silih berganti. Dalam penjajahan itu bangsa Indonesia diperlakukan tidak adil, dan kekayaan alam dirampas. Keinginan seperti ini ternyata sudah pula menjadi pemikiran para filosof Muslim. Karena itu, di sinilah signifikansi membandingkan kedua konsep adil dan makmur tersebut.

Abstract

Menggala city that is estimated had born since 1541 with its homogen people and its strong tradition in society living. Even though this city had been ever become international port, but the power of society culture is still steady. After new order era, poorly, there is movement of norm phenomenon that seen clearly, especially in youth relationship ethics.Since colonial until new order era, the leaders of its tradition still capable to become model and builder for the society in culture and religion field. But, now they almost powerless and very urgent to be strife for look after culture field as national asset. For this purpose, it is needed same vision, mission and concrete action from the founders, tradition, and society leaders, or officer including its local bureaucrats, in order to work together to build up their culture and religion norm at all society level

Abstract

Abstract The author conducts research on the content of customary law or traditions that have been in force for centuries ago which are still firmly used as guidelines for living together for members of the indigenous Migou Pa 'Tulangbawang Lampung community. what is the background of the tradition so that for so long it can survive as if it was not deterred by the current wave of rapid social change. Then how is the technical consultation in the direction of consensus on the traditional tradition of the Megou Pa 'Tulangbawang indigenous community. The author uses descriptive qualitative research type. As for primary data sources from the results of interviews with free guided interview methods and secondary data sources, namely books that support research. The results of the author's research are in the traditional Peppung style of the Megou Pa Indigenous people, indeed it applies the one man one vote system, but even the voice of one person from a number of Peppung participants or a trial to hear a case must be able to accept something to make a decision. close to customary law. If it concerns common business interests, the majority of votes are often the benchmark in making decisions, but it is not impossible that the voice of one person by the majority of the voting or counseling participants is considered more appropriate, logical or in accordance with tradition or law. custom then it can be used as the basis of the decision. In Peppung or counseling even though the problem is so complicated but there has never been a vote to make a decision or deliberation, because the basis of consideration is customary law, tradition or something considered rational rational. Keywords: Peppung, Lampung Tradition, and Megou Pa custom Abstrak Penulis melakukan penelitian terhadap kandungan hukum adat ataupun tradisi yang telah berlaku sejak berabad–abad yang lalu ini yang tetap masih kokoh dijadikan pedoman hidup bersama bagi para anggota masyarakat adat Migou Pa’ Tulangbawang Lampung. apa yang melatar belakangi tradisi itu sehingga sampai sekian lama dapat bertahan seolah–olah tak tergoyahkan oleh gelombang perubahan sosial yang demikian pesatnya saat ini. Kemudian bagaimana tehnis musyawarah dalam menuju mufakat pada tradisi permusyawaratan masyarakat adat Megou Pa’ Tulangbawang. Penulis menggunakan Jenis Penelitian Kualitatif deskriptif.Adapun sumber data primer dari hasil wawancara dengan metode wawancara bebas terpimpin dan sumber data sekunder yaitu buku-buku yang menunjang penelitian. Hasil Penelitian Penulis adalah Dalam Peppung Adat ala masyarakat Adat Megou Pa’, memang memberlakukan sistim one man one vote, namun suara satu orang sekalipun dari sejumlah peserta peppung ataupun sidang untuk mengadili suatu perkara tetap harus dapat menerima sesuatu untuk di jadikan keputusan adalah pendapat yang paling dekat dengan hukum adat.Jika hal itu menyangkut kepentingan usaha bersama suara terbanyak memang sering menjadi patokan dalam mengambil keputusan, hanya saja tiddak mustahil terjadi bahwa suara satu orang yang oleh mayoritas peserta peppung atau berembuk itu dipandang lebih tepat, logis ataupun sesuai dengan tradisi atau hukum adat maka itu dapat dijadikan dasar keputusan. Dalam peppung atau berembuk sekalipun masalahnya demikian pelik namun tidak pernah terjadi voting untuk mengambil keputusan peppung atau berembuk itu, karena yang menjadi dasar pertimbangan adalah hukum adat, tradisi ataupun sesuatu yang dianggap logis rasional. Abstract

Abstrak Anomali dalam beberapa ayat dari Hukuman Sepanjang Hadat Lampong dalam Hukum Adat Masyarakat Migou Pa’ Tulang Bawang Lampung, memang sepintas ayat – ayat itu tidak Islami namun setelah ditelusuri ternyata hal itu dimaksudkan agar para anggota pepadun dari pelaku bisa mengantisipasi ataupun meredam kemungkinan ada nya kerusuhan, jangan sampai person diluar pelaku itu justeru membuat suasana semakin memanas jika ada bibit–bibit kerusuhan. Keadaan akan jauh berbeda jika tindakan criminal itu seperti pencurian, pelecehan seksual maka segala resiko akan ditanggung sendiri oleh pelaku tindak criminal itu, sebab hal semacam itu dianggap sebagai tindakan yang sangat memalukan. Hanya saja tidak bisa dipungkiri bahwa anggota pepadun lainnya tetap menanggung rasa malu, tidak hanya pada generasi yang bersangkutan tetapi bahkan sampai turun temurun. Kata Kunci: Hukuman Sepandjang Hadat Lampong, Prefentif, Pepadun.

Abstract

THE APPOINTMENT A NON-MUSLIM LEADER IN PERSPECTIVE OF IBN TAYMIYYAH. Controversy on the appointment   of  a  non-Muslim  leader  among  the  majority  of Muslims emerges frequently. Historically, the issue has been going on for a long time and always invites debates among the Muslim scholars from time to time. In response to this issue, the scholars are divided  into  two  camps, most  of them  forbid it but others allow.  One  of the  scholars  allowing  the  appointment   was  Ibn Taymiyyah, a great Islamic thinker of his time. He was famous of his controversial statement “better led by a fair pagan than led by a tyrannical Muslim leader”. This article illustrates the relevance of “liberal” thought  of Ibn Taymiyyah  on the administration of state,  especially  on the  issue  of the  non-Muslim  leadership  in the middle of the vast majority  of Muslims. This view is quite relevant  to address the uncertainty  of the majority  of Muslims who are hostile to each other in choosing a candidate  while the proposed candidate does not deserve to be a leader.
