Abstract

By arguing that religion as interpretative culture of people in their context, suggested by Clifford Geertz, this paper proposes an interpretation-oriented approach to the texts of the hadith of the Prophet Muhammad rather than a critical-deconstructive approach. The interpretation-oriented approach focuses on positive reading towards the hadith that advocates issues of gender justice; whether through selecting classical methods of interpretation or applying contemporary methods suggested by progressive Muslims. As this approach does not challenge the authority of the hadith, which is accepted culturally by majority of Muslims as second source after the Quran, cultural works for gender justice are assumed to be relatively more flexible and can be further maximized. By doing so, I argue that this cultural dimension of religion –accepting its sources and working on the field of interpreting them-should be considered in promoting gender justice among Indonesian Muslims.

Abstract

Dalam banyak analisis (Altorki, 1986; Olivetti, 2001; Algar, 2002; dan Abou El-Fadl, 2004), metode pemahaman Mazhab Salafi Saudi yang tekstual dan literal adalah pangkal dari pandangan-pandangan mereka yang kaku, keras, tidak ramah pada yang berbeda, dan diskritimatif terhadap perempuan. Dengan mendeskripsikan lima prinsip Ushul Fiqh Mazhab ini, tulisan ini memandang bahwa tekstualitas yang literal sekalipun sesungguhnya juga sangat kompleks dan membuka kemungkinan pada negoisasi dan perubahan. Kelima prinsip yang dimaksud adalah; (1) Teks yang otoritatif tidak terbatas pada al-Qur’an dan Hadits, tetapi juga pandangan Sahabat, dan Tabi’in; (2) Otoritas hadits mutawatir adalah sama dengan ahad; (3) Kritisisme sanad Hadits dalam ilmu Hadits menjadi penentu penerimaan dan penolakan suatu hadits; (4) Membatasi secara ketat dari penggunaan qiyas, dan segala jenis interpretasi berbasis akal pikiran; dan (5) Metode interpretasi yang literal terhadap teks-teks al-Qur’an dan Hadits.

Abstract

The position of woman and knowledge in Islamic perspective has been an interesting issue in Islamic studies. One of the female Muslim scholars who focus her studies on feminism is Sa’diyya Shaikh. By exploring Gadamer’s philosophical hermeneutics, this paper is aimed at explaining the basic concepts of the philosophical hermeneutics of Sa’diyya Shaikh’s “Knowledge, Women, and Gender in the Hadith: a Feminist Interpretation” published in 2014. The work is focused on the interpretation responding to the selected texts of the Hadith in “The Book of Knowledge”, the collection of the prophetic traditions by Sahih al-Bukhari. It was found out that prejudice influences Shaikh’s motivation in interpreting the text. However, as there are neither merely subjective nor objective aspects in the interpretation, Shaikh positions herself in the structures of self-understanding which reveal “the truth” for her within a horizon.
